Small Business Restructure Case Study 📚

🔨 Background: A regional NSW trades business had historically operated a viable, profitable model. Short-term cash flow pressure built up from two compounding events: an extended business partner buyout that carried unresolved costs and uncertainty for around 18 months, and a run of severe weather that disrupted work.

💵 The proposal: An upfront lump sum shortly after acceptance, followed by two further instalments over the next 12 months, funded by a related party, providing an estimated return to creditors of 33.9 cents in the dollar.

🌅 The outcome: Creditors voted to accept the Plan. The company continues to trade and retains its employees.

As noted above, the proposal is projected to return roughly 33.9 cents in the dollar to unsecured creditors, compared with an estimated 0 to 9 cents in the dollar in a liquidation of the same business. SBR isn't a fit for every business in financial difficulty, but where the underlying trading model is sound and directors act early, it can preserve value and provide a genuine reset.
