New Financial Year. New Rules. Are You Ready?

From 1 July, there are important changes that every employer and business owner should be aware of.

1. Same Day Super is Here
Employers are now required to ensure superannuation is paid at the same time employees are paid, replacing the traditional quarterly payment approach. This means businesses need to have payroll processes and cash flow aligned to meet these new obligations.

2. New Anti-Money Laundering (AML) Rules
Australia’s AML/CTF reforms are expanding to include more professional service providers, including many accounting firms. As a result, you may be asked to provide additional identification and information as part of new client verification and compliance requirements.

What does this mean for you?
• Review your payroll processes to ensure super is being paid correctly.
• Be prepared for enhanced identity verification when dealing with your accountant and other professionals.
• Stay informed to avoid unnecessary compliance issues.

At Action Tax Services, we’re here to help you navigate these changes with confidence.

Today, The High Court of Australia handed down its decision in Commissioner of Taxation v Bendel, with the court ruling in favour of the taxpayer.

“This ruling brings long‑awaited judicial certainty to an area of trust taxation that has been the subject of significant controversy and compliance activity for more than a decade,” says Julie Abdalla, Head of Tax & Legal at The Tax Institute.

Isn’t the timing interesting?

The proposed trust tax changes would see trustees pay tax at 30%, with individual beneficiaries receiving a credit for that tax to prevent double taxation.

However, that same credit does not appear to flow through to corporate beneficiaries (bucket companies). The result? Trust income could effectively be taxed at 30% in the trust and then again at 30% in the bucket company.

Then, not long after the taxpayer victory in the Bendel case reaffirmed the long-standing use of unpaid present entitlements and bucket company arrangements, we see proposed changes that could significantly reduce the effectiveness of those same structures.

Coincidence?

Perhaps. But it’s certainly remarkable timing.

After decades of accepted trust planning, the combination of the Bendel outcome and the proposed trust tax measures raises an obvious question: is this simply tax reform, or a deliberate move away from bucket company strategies altogether? 🤨

ASIC warning ! Don’t get caught out!

Unsolicited ‘business name’ renewals and ‘company review’ notices…

As a marketing ploy.. Allegedly impersonating ASIC and (often considered to be) misleading and deceptive conduct!

This has ben happening for DECADES - sole traders, small businesses and small business directors being unwittingly caught paying additional unnecessary fees to third parties.

We’re delighted to see ASIC has now issued a warning to business owners about this conduct.

Share this with your business friends.. Don’t let them get caught out by these unnecessary fees.

Small business owners shouldn’t be permitted to be preyed upon by these opportunistic practices.

If you are ever unsure.. we can assist you!
