Foreign Company But Living in India? POEM Rule Can Make You Taxable in India

Many founders believe:

👉 “If my company is registered in Dubai or Singapore, I don’t need to pay tax in India.”

This is NOT always true.

Under the Income Tax Act, 1961, there is a powerful concept called:

📌 Place of Effective Management (POEM)

If the key management decisions of your foreign company are taken from India,
then your company may be treated as an Indian tax resident.

That means:
✔ Global income may become taxable in India
✔ Compliance obligations increase
✔ Litigation risk rises

Just incorporating abroad does NOT automatically mean tax freedom.

Before you structure overseas, understand POEM properly.
