⚖️ महत्वपूर्ण आयकर न्यायिक निर्णय

दिल्ली हाईकोर्ट ने स्पष्ट किया कि यदि विभाग द्वारा डिमांड ऑर्डर, रेक्टिफिकेशन ऑर्डर या पेनल्टी इंटिमेशन की विधिवत सेवा (Service) साबित नहीं की जा सके, तो केवल Section 220(1) के तहत Assessee-in-Default मानकर नोटिस जारी नहीं किया जा सकता।

📌 मुख्य बिंदु:
• विभाग केवल ई-मेल भेजने का दावा करके सेवा सिद्ध नहीं कर सकता।
• कई वर्षों तक विभाग की निष्क्रियता (Dormant Approach) को कोर्ट ने गंभीरता से लिया।
• बिना उचित सर्विस के भारी टैक्स डिमांड मान्य नहीं मानी जा सकती।
• कोर्ट ने Section 220(1) का नोटिस रद्द (Quash) कर दिया।
