扩大的销售与服务税(SST) 将于7月1日生效,涵盖六个新增服务类别:租赁、建筑、金融、私人医疗、教育和美容。

主要内容总结:

租赁服务:

年租赁收入超过50万令吉的公司需缴纳8%服务税。

住宅建筑、阅读材料、海外资产和特定金融租赁豁免。

年收入低于门槛的微型、小型和中型企业(MSME)豁免。

私人医疗服务:

非公民需缴纳6%服务税。

马来西亚公民豁免,包括传统医疗(马来、中医、印度、伊斯兰医学、顺势疗法、脊椎指压、整骨疗法)。

辅助医疗服务(物理治疗、听力学、语言治疗)对马来西亚人继续豁免。

教育服务:

私立幼儿园、小学和中学,若每名学生年学费超过6万令吉,需缴纳6%服务税。

马来西亚学生和残障人士豁免。

高等教育:仅对国际学生征税,马来西亚学生豁免。

美容服务:

如企业12个月内应税服务价值超过50万令吉,需缴纳8%服务税,涵盖美容护理和美发。

建筑服务:

年收入超过150万令吉的建筑服务提供者需缴纳6%服务税。

住宅建筑和公共住房相关工程豁免。

企业对企业(B2B)交易豁免,避免重复征税。

金融服务:

涉及手续费或佣金的金融服务需缴纳8%服务税。

基本金融服务豁免,包括:

一般银行交易、

伊斯兰金融机制、

外汇收益、

出境汇款、

与资本市场相关服务。

On 6 June 2025, Lembaga Hasil Dalam Negeri Malaysia (LHDN) announced that, under Budget 2025, the government will implement the Self-Assessment System for Stamp Duty (STSDS) starting 1 January 2026.
2025年6月6日,马来西亚内陆税收局(LHDN)宣布,根据2025年财政预算案,政府将于2026年1月1日起分阶段实施印花税自我评估系统(STSDS)。

During recent stamp duty audits, LHDN found many employment contracts between employers and employees were not stamped as required under the Stamp Act 1949.
在近期的印花税审计中,LHDN发现许多雇主与员工之间的聘用合约未按《1949年印花法令》规定盖章。

To reduce employer burden, the Ministry of Finance has issued the following decision:
为了减轻雇主负担,财政部作出以下决定:

Employment contracts finalized before 1 January 2025 are exempted from stamp duty and late stamping penalties.
2025年1月1日之前签署的聘用合约将豁免印花税和迟交盖章罚款。

Contracts finalized from 1 January to 31 December 2025 are subject to stamp duty, but exempted from late stamping penalties if stamped on or before 31 December 2025.

2025年1月1日至12月31日期间签署的聘用合约需缴付印花税,但若在2025年12月31日或之前盖章,则免除迟交盖章罚款。

Contracts finalized from 1 January 2026 onwards are subject to stamp duty and late stamping penalties.
2026年1月1日或之后签署的聘用合约将全面征收印花税并征收迟交盖章罚款。

All employers are advised to review and organize all employment contracts signed or to be signed, to ensure compliance with the Stamp Act 1949.
所有雇主应立即检查和整理所有已签署或即将签署的聘用合约,以确保符合《1949年印花法令》的盖章规定。
