① 什么是 Withholding Tax？（超简版）

🧾 Withholding Tax = 代扣税
当你向外国公司购买某些服务时，必须从付款中扣起一部分（通常 10% 或 15%），代付给 LHDN。

比如：
🌐 Google Ads
📱 Facebook Ads
☁️ AWS / Google Cloud / Microsoft Azure
🎵 Software Subscription（国外）
🎨 外国 freelancer 设计、剪片

❗ 很多 SME 不知道自己已经触发 WHT，结果被 LHDN 追税 + 罚款。

② Online Advertising 需要 Withholding Tax 吗？

简短回答：
要看服务性质！

📢 Google Ads / Facebook Ads / TikTok Ads
➡️ 一般视为 广告服务，属于 S109B – “Digital Advertising”.
➡️ WHT 10%（如果外国公司没有常驻马来西亚）

❗ 很多人以为“我只是 top-up credit，不是服务”，但实际：
✔ 只要你付钱给 外国服务商 → 很大机会要 WHT。

③ Cloud 服务也要 Withholding Tax？

如果你有用：
☁️ AWS
☁️ Google Cloud
☁️ Microsoft Azure
☁️ Shopify / Canva / Zoom
☁️ 外国 CRM / ERP / SaaS 软件

这类大部分属于 services / license / subscription
➡️ 可能触发 WHT 10% 或 15%（视服务类别而定）

④ 如果没有扣 Withholding Tax 会怎样？

LHDN audit 时可能会：

⚠️ 追补税（10% 或 15%）
⚠️ 加上 10% penalty
⚠️ 某些情况下 penalty 可高达 100%

最麻烦是：
👉 “你没扣税，也没代付，就算服务已经用完，钱也付了，还是要被追。”

⑤ SME：怎样知道自己需不需要缴？

快速 checklist：

✔ 服务商是不是外国公司？
✔ 付款是不是给外国公司？（非马来西亚银行）
✔ 购买的是广告 / cloud / software / subscription / royalty？
✔ invoice 是外国地址？
✔ monthly subscription？

如果以上符合 2 项以上，很大机会要 WHT。

⑥ 怎样缴 Withholding Tax？（简单概念）

🎯 3 步：

1️⃣ 向外国服务商付款时扣税
2️⃣ 在 次月月底之前 用 e-TT 付款给 LHDN
3️⃣ 填 Form CP37 / CP37A（根据类别）

⑦ 老板最常问的问题

❓“Facebook/Google 没叫我扣税，我还要扣吗？”
➡️ 是的，WHT 是买方（你）的责任。

❓“我没有扣，现在才知道…怎么办？”
➡️ 可以补税，但可能会有 penalty。

❓“用 PayPal 付给外国 freelancer，要扣 WHT 吗？”
➡️ 如果是服务（design、editing、coding）→ 多数 要扣。
