Is your nanny on the payroll?
If you pay (check or cash) your house employee more than $1000 in any quarter or more than $2300 annually, you are required to register for payroll, remit payroll taxes, issue a W2 and comply with DOL rules (disability and workers comp insurance). If you didn’t, and your babysitter or nanny gets hurt or fired, she/he will file a liability or unemployment claim against your household and then you are screwed. It’s is not easy to ask for forgiveness in this case. DOL and tax authorities will come after you for their share - back taxes, interest, penalties for late filings, actual payroll returns and additional accounting and legal fees. Don’t wait to get caught, prevent your losses by registering and filing payroll today.

Tax Season Continues
The IRS extended tax season to May 17 for individuals. C corporations, estate, trust and gift income tax filings are due April 15.
If you usually pay estimated tax during the year, the first payment for 2021 is also due April 15.

The $10,200 unemployment income exclusion is already updated in most tax software. If you already filed your 2020 return, an amended return is not required. The IRS will calculate and issue a refund. The IRS will start issuing refunds sometime in May.
New York is currently decoupled from the federal American Rescue Plan act and all unemployment income is subject to tax.

03/15 S corporation(1120-S), partnership (1065) income tax returns and tax due;
It is also last day to request 6 months extension for S Corp or partnership. Remember, extension gives extra time to file but does not extend time for tax payment.
April
04/15 “Income Tax Day” C corporation, LLC single member and individual income tax returns are due along with tax payment. Last day to file 6 months extension for C corp, LLC and individuals
Q1 2021 quarterly estimated taxes are also due on 4/15
June
06/15 Q2 2021 second quarterly estimated tax due
September
09/15 extended S- corporation and Partnership income tax filing are due
Q3 estimated taxes also due 09/15
October
10/15 extended sole proprietorship, LLC single member and C corporation tax returns are due
January 2022
01/15 Q4 estimated taxes are due
01/31 1099 NEC and W2
State and local tax payments and filings due dates varies by location, business activity and actual amounts.

Tax season starts February 12
I know many of you are eager to file your income tax returns. Although the IRS will start to process returns and refunds on February 12th, you can file your taxes through your tax preparer earlier so your return is at the beginning of the queue.
Below are tax documents you should receive by February 1:
W2, 1099 Int, 1099 Div, 1099 G (unemployment benefits), 1099-SSA (social security), IRA contributions and distributions. In addition to the usual deductions you are now allowed to deduct up to $300 in charity donated to eligible organizations in 2020 even if you don’t itemize.
For taxpayers who itemize expenses- mortgage interest (form 1098), medical expenses, real estate taxes, unreimbursed employee expenses, union dues, and, for teachers, educator expenses can all save you on taxes. Also, if you received stimulus checks for less than the full amount you may be eligible for additional credit.

Did you receive your stimulus check?

If you answered yes, great! Keep a record of the amount received and provide it to your tax preparer. The stimulus received was actually an estimate of the actual credit. The actual credit will be calculated on your 2020 tax return and reconciled to the advance. This means you may get additional credits on your taxes if you received less than full amount.

The stimulus credit is based on your 2020 income. Single taxpayers below $75000 and married taxpayers below $150,000 will get the full amount. You’ll also get an additional $500 for each dependent reported in 2020.

If you answered no, don’t worry. You’ll get the credit you are entitled to when you file your return. All the more reason to file early! And don’t forget, you can always check the IRS website for the status of your payment.
