The goal is never to avoid what you legitimately owe. The goal is to make sure you are not paying more than that because you waited too long to plan.

NYC's proposed pied-à-terre tax and millionaire surcharge are still being written, the tax rates have not been set, the rules around LLC and trust-owned properties have not been decided, and the interaction between the proposed surcharge and existing city business taxes has not been resolved.
That unresolved status is not uncertainty to fear but rather a planning window to use while it remains available.

Business owners and property owners who act before the legislation is finalized have more tools available to them than those who wait for the final bill and then attempt to respond after the fact.

The law does not get written with your specific structure in mind, and that is precisely why your strategy should be built before the law is finalized rather than in reaction to it.

Can you tell me right now what your top three business expense categories were last month?
Not an estimate. Not a general sense of where the money goes. The actual categories, with actual numbers.

If the answer requires pulling a report and spending twenty minutes in your accounting software, that is useful information about your current relationship with your books.

Misclassified transport and fuel expenses are one of the most common triggers for IRS scrutiny of small business returns.

Most business owners do not know this until they are already in a review.

The IRS requires that every vehicle and transportation deduction be supported by four things: the date of the trip, the destination, the business purpose, and the mileage. Without all four, that deduction is at risk. When expenses are recorded but never reviewed, that documentation is frequently absent or inconsistent with what was claimed.

The outcome is a situation where two harmful things happen simultaneously. The business has overspent because no one caught the error while it was occurring, and then the deduction is lost because the paperwork cannot hold up to scrutiny. You are penalized twice: once through the unchecked spending and again through the lost tax benefit.

A consistent bookkeeping review process catches the documentation problem before it becomes an audit problem.
