Potential Regulation Change:

The Federal District Court for the District of Columbia has "invalidated" the 2020 HMDA increase in the closed-end loan volume threshold. They are arguing that the cost-benefit analysis the CFPB used to support the increase threshold and giving smaller institutions a relief is no longer valid.

The CFPB increased the closed-end loan volume threshold to 100 from 25 loans in 2020. The CFPB has not published a comment; however, we are not expecting them to appeal this. We will keep you updated on the changes that go forth, but prepare for the change.

BCA recommends tracking HMDA data even if you are not reportable as changes frequently occur and it is difficult/time consuming to go back and gather the information. We will keep you updated as this develops.
