Thinking an SMSF can borrow to buy any type of property? The rules have changed.
New SMSF borrowing rules now apply to limited recourse borrowing arrangements used to purchase property.
Under the changes, property purchased through a new LRBA generally needs to meet the business real property (BRP) definition.
The important part is that BRP is based on how the property is used, not simply whether it is classified as commercial or residential.
There are also transitional rules that may apply to certain arrangements entered into on or before 10 August 2026.
Existing LRBAs over non-BRP assets can generally continue under the new rules, subject to the relevant requirements.
If you have an existing LRBA or are considering using one to purchase property, specialist advice is important before making any decisions.
