Lodging a Tax Return Through a Friend Using MyGov
I am receiving several queries where taxpayers have received audit letters and penalties for claiming deductions that are either not work-related or not claimable. When I ask, “Why did you claim these expenses when they were never incurred?” the common response is: “My friend did my tax return.”
Using someone else’s myGov account—even with permission—is considered:
• Unauthorised access under ATO and myGov terms of use
• A breach of the Privacy Act 1988 (Cth) and the Taxation Administration Act 1953
• It may be deemed a criminal offence, especially if the friend lodges on behalf of the taxpayer without being a registered tax agent
Consequences may include:
• Investigation by the ATO of both parties
• Revocation of myGov/ATO access
• Imposition of penalties
If false information is submitted—accidentally or deliberately—the consequences can be serious:
• Administrative penalties (up to 75% of the tax shortfall)
• Prosecution for fraud or false declarations
• Audit or review of multiple financial years
The ATO does not accept “My friend did it” as a valid excuse.
Security and Identity Risks
Sharing your myGov login or TFN with a friend can:
• Compromise your personal data and security
• Create risks of identity theft, Centrelink fraud, or Medicare record tampering
Correct and Safe Options:
• Lodge your return yourself via myGov > ATO
• Use a registered tax agent (check their status at www.tpb.gov.au)
