Holiday Homes and Tax Deductions: Big Changes Ahead

The Australian Tax Office (ATO) has released draft guidance that could significantly impact holiday home owners from July 1, 2026. The key message?

If your property isn’t genuinely available for rent during peak periods, you may lose deductions for major holding costs like mortgage interest, council rates, and insurance.

For years, the “golden rule” was simple: if your property was available for rent, you could claim deductions—even if it wasn’t tenanted. That rule is about to change. The ATO now wants to ensure properties are mainly used to produce rental income, not just as a personal getaway.

What does this mean for owners?
* Peak periods matter: Think Christmas/New Year, Easter, school holidays, and major event seasons.
If your property is blocked out for personal use during these times, expect deductions to be denied.
* Direct rental costs (cleaning, advertising) remain deductible, but holding costs will be under scrutiny.
* Detailed records will be essential: advertising efforts, booking calendars, income reports, and private use dates.

Why the shift?
The ATO is targeting properties that are effectively private holiday homes disguised as rental investments. This move could hit hardest in states like Victoria, where additional levies already apply.

What’s next?
The draft is open for consultation until January 30, 2026, but significant changes are unlikely. Owners should start reviewing their rental strategies now to ensure compliance.

Bottom line: If you own a holiday home, the era of passive deductions is ending. Make sure your property is genuinely available during peak periods—or prepare for a very different tax outcome.
