The legislation has not.
The restructure can wait. The asset purchase cannot.
That is the situation a lot of accountants are in right now. A client calls. They are buying a business, a property, or an asset. Settlement is in three weeks. They need a structure today β€” not when the legislation is finalised, not when the dust settles. Today.
And you have to give them one.

The challenge is that the structure you recommend today has to do three things at once. It has to work under the current rules. It has to hold up under what you believe the future rules are likely to be. And it has to give the client a clean pathway to restructure out of it later β€” without triggering a tax event β€” if the final law lands differently from what you expected.

That is not a simple equation. And I have not seen it addressed anywhere with the level of practical specificity it deserves.

The ATO's draft ruling TR 2025/D1 marks a significant shift from the longstanding IT 2167. The rules around interest, rates, repairs, and other deductions on holiday homes and Airbnb-style rentals have tightened β€” and the new benchmark is "genuine income-producing purpose."

For clients with mixed-use or short-term rental properties, that's a meaningful change. Arrangements that were compliant under the old guidance may not hold up under the new position.
