** New Tax Court Case: GST/ HST Still Applies to Build‑and‑Sell Homes**

**Caddell v. The King (2026 TCC 27)** confirms that **living in your newly built home for a short time does NOT exempt you from GST**.

The taxpayers repeatedly bought land, built homes, moved in briefly, and sold for profit. Over 11 years: **7 properties purchased, 5 sold**.

The Court agreed with CRA — this pattern made them **“builders”**, so the **GST self‑supply rules applied**.
The personal‑use exception didn’t apply.

**Takeaway:**
If your activity looks like a business, GST/ HST will follow — even if you live in the home before selling.
