Everything you’re building . the home, the savings, the investments - you’re building at least partly for them. But in Canada, what your kids actually receive and what you think you’re leaving them are two very different numbers. Before they inherit a dollar, the CRA takes its share, probate takes a cut, and what’s left is often six figures lighter than you pictured. Not over a lifetime of income tax , though that’s real too. This is what leaves the family in a single moment: the day the CRA applies its deemed disposition to your RRSPs, your investments, and your properties at death.

For a typical Ontario family with a home, some savings, and a rental, half a million dollars can walk out the door before the kids see a cent. Most families never run the number, because no one ever offered to. When they finally see it, the reaction is always the same , why did nobody tell me this?

The wealthy don’t have a secret tax rate. They have a structure. While most Ontario families let their investments get taxed on every sale and their RRSPs get taxed on every withdrawal, the wealthiest families hold a portion of their wealth in an asset that grows completely tax-sheltered -and pays out completely tax-free at death. They borrow against it instead of selling and triggering tax. They keep their money working in two places at once. It’s not a loophole. It’s the Income Tax Act, used the way almost nobody is ever shown how to use it.

Most Ontario families invest for the highest return they can find. That’s not the mistake. The mistake is ignoring what the CRA takes on the way out. Every time you sell a stock or a property for a gain, tax comes off the top. Every dollar in your RRSP gets taxed as income the moment you withdraw it. You can earn a fantastic return and still hand a huge share of it straight to the government. The wealthiest families think in after-tax terms from day one -and they hold at least one asset that grows and transfers with no tax at all. Most families have never owned it.

Your lawyer drafts your will, and most Ontario families assume that means their estate is handled. But a will only decides who receives what. It does nothing to reduce what the CRA takes before your family ever sees a dollar. That’s a completely different job ,and it’s not the one your lawyer was hired to do. So families walk away with a beautifully drafted will and a six- or seven-figure tax exposure sitting entirely unaddressed. Your lawyer isn’t the problem. The gap between drafting a will and actually protecting an estate is.
