📢 Spanish Tax Return (IRPF) 2025/26 — are you ready?

The annual Declaración de la Renta campaign is one of the most important tax periods of the year in Spain — and every year, many residents are unsure about what needs to be declared.

If you are a tax resident in Spain, your tax return may include:

✔️ Employment or self-employment income
✔️ Pension income
✔️ Rental income
✔️ Overseas income or assets
✔️ Capital gains and investments

And as many people quickly discover… Spanish tax rules are not always as simple as a quick chat over café con leche might suggest ☕🇪🇸

Leaving everything until the last minute often leads to unnecessary stress, missing documents, or avoidable mistakes — especially when international income is involved.

📄 Spain Regularisation 2026 — what does it mean for you?

A new regularisation process has been introduced in Spain through Royal Decree 316/2026, creating a potential pathway to legal residency for certain foreign nationals already living in the country.

However, this is not an automatic process — and it comes with specific requirements and conditions that must be carefully met.

Among the key points:

✔️ It is aimed at individuals already residing in Spain
✔️ Applicants must meet certain legal and administrative requirements
✔️ The process is time-limited, with a defined application window
✔️ Proper preparation and documentation will be essential

As with many immigration procedures in Spain, understanding the details early can make a significant difference.

📖 In our latest article, we explain how this regularisation works, who may qualify, and what to consider before applying.

👉 Do you have any questions about this new regularisation process in Spain?
Feel free to ask in the comments — we’re happy to help clarify.

Spain's extraordinary regularisation window is open until 30 June 2026. Find out if you qualify and which pathway to choose with ABAD Abogados.

🔨 Thinking about buying property at auction in Spain?

It might seem like a great way to secure a bargain… but auctions come with their own rules and risks that aren’t always obvious at first glance.

Before getting involved, it’s important to know:

✔️ You’ll need to register and place a deposit to participate
✔️ The process follows strict deadlines and procedures
✔️ Properties are often sold as they are, without the usual guarantees
✔️ There may be outstanding debts or legal issues attached to the property

While auctions can present opportunities, they also require careful preparation and a clear understanding of what you’re bidding on.

It’s not just about the price — it’s about knowing exactly what you’re taking on.

📖 We explain the full process and what to watch out for in our latest article on the website.

❌ Myth Busting

💭 Myth:
“I don’t need to declare my assets or income from abroad.”

⚖️ Reality:
If you are a tax resident in Spain, you are generally required to declare your worldwide income — and in some cases, your overseas assets too.

This can include:
▪️ Bank accounts held outside Spain
▪️ Property in another country
▪️ Investments or pensions abroad

It’s one of those areas where many people assume “it doesn’t apply to me”… until they realise it does.

And with Spanish tax rules, it’s always better to be sure than to guess.

📢 2025 Spanish Resident Tax: common mistakes to avoid

The 2025 Spanish income tax campaign runs from 8th April to 30th June 2026.

Here are a few of the most common mistakes made when presenting:

❌ Assuming you don’t need to file
❌ Forgetting to declare foreign income or assets
❌ Not applying available deductions
❌ Using outdated or incorrect personal information
❌ Leaving everything until the last minute

Spanish tax rules can be more complex than expected — especially if you have international income or recently became a resident.

A little preparation now can save a lot of stress later (and possibly some unwanted surprises from the tax office).

🌧️ Rainy Day Myth Busting

With the rain keeping everyone indoors today, let's clear up another myth we hear quite often from property owners in Spain.

💭 Myth:
“If I don’t rent out my property in Spain, I don’t have to pay any taxes on it.”

⚖️ Reality:
The Spanish tax office doesn’t take into account whether your property is only used for sunny holidays, long lunches on the terrace, or the occasional stroll to the local panadería.

Even if the property is never rented out, non-resident owners usually still need to file a tax return in Spain. This is known as Non-Resident Tax, simply because the property is available for your personal use.

It’s one of those rules that tends to surprise many foreign owners.

👉 Have you ever been caught out by a Spanish rule or tax you didn’t expect?

📘 Inheriting property in Spain as a non-resident — what you really need to know

If you’ve recently inherited a villa, apartment, land, or any asset in Spain from a loved one, it can be both emotional and legally complex. The process includes strict deadlines, paperwork from abroad, and tax obligations that must be handled correctly before the property can be registered in your name.

Key things non-resident heirs should be aware of:

🔸 Foreign documents must be properly legalised (apostille + sworn translation) before they are accepted in Spain
🔸 You will need an NIE/NIF number to deal with taxes and the property registry
🔸 Spanish inheritance tax must be filed within six months from the date of death
🔸 Regional tax reductions may apply, depending on where the property is located
🔸 Plusvalía municipal (local land value tax) may also need to be declared

Many families are surprised by how different the Spanish inheritance process is compared to their home country. That’s why we’ve prepared a clear, step-by-step guide explaining what to expect and how to avoid common mistakes.

❌Myth:
“If my official home is abroad, I can’t be tax resident in Spain.”

✅Reality:
If you spend more than 183 days in Spain, you’re very likely a Spanish tax resident — regardless of where your “official” home is.

Spanish tax residency is based on where you actually live your life, not where your paperwork says you live.

Spain counts days, not intentions.

And if by August:

- the staff at your local chiringuito know your order 🍻

- you’re involved in local gossip 🗣️

- and “just visiting” feels like a stretch 😎

…it may be time to check your tax status.

The rule sounds simple.
The consequences aren’t.

If you’re spending a lot of time in Spain, it’s worth getting clear advice before Spain decides for you. 🇪🇸
