Whoops! I don’t understand why people leave it so late!

My last return was filed yesterday and I thought that was late enough!

People risk a penalty, the HMRC has warned, without a reasonable excuse for delays.

HMRC are launching another one-to-many campaign aimed at dog and cat breeders. Their particular concern is that many animal breeders have failed to register for self-assessment.

It is not clear how much tax HMRC anticipates being at stake but it is understood their information has come from a wide range of sources including pet insurers, the RSPCA and online trading sites along with social media. Given the surge in pet ownership during the pandemic, HMRC's interest is understandable.

This is a copy of the letter that is being issued:

You may need to declare income from the breeding or sale of animals.
We have information that shows you’ve earned money (income) from the breeding or sale of animals.
We believe you may not have told us about some or all of this income. This means you may owe tax.
We understand tax can be complicated, so we want to help you get it right.

You must tell us each year if your annual gross trading income is £1,000 or more, from one or more trades.

How to tell us about any undeclared income If you have any undeclared income, you can tell us online and pay any tax you owe. We call this a voluntary disclosure.

To do this, go to GOV.UK and search 'Tell HMRC about underpaid tax from previous years' and follow the steps. Please include the letter reference. Once you start the process, you’ll then have 90 days to complete your disclosure and pay anything you owe. For more information about making a voluntary disclosure, go to GOV.UK and search ‘make a voluntary disclosure’. If you need longer to start the disclosure process, you can ask for this time limit to be extended. You must do this before the deadline. To ask for an extension or if you believe you don’t need to make a disclosure, please call 0300 1230 998 or email [email protected] You’ll need to quote the reference at the top of this letter.

We may start a check into your tax affairs if:
• you don’t respond
• we find you haven’t declared the right amount of income or paid the right amount of tax,

Information about penalties If we find you owe tax and didn’t pay on time, we’ll ask you to tell us how the error happened. We’ll use this information to help us decide whether to charge you penalties. If you have any income to disclose, we’ll treat your disclosure as being 'prompted'. This is because you didn’t voluntary disclose your income to us before we sent this letter. This could affect any penalties you might have to pay.

Contact me if you need further advice.

Thanks

Emma

Are you planning to treat your staff this Christmas?

Employers can provide trivial benefits to employees without incurring tax liabilities.

To qualify as a trivial benefit, a number of conditions must be met which are that the:

Cost of providing the benefit does not exceed £50.
Benefit is not cash or a cash voucher.
Benefit is not provided under salary sacrifice arrangements or any other contractual obligation.
Benefit is not provided in recognition of particular services performed by the employee in the course of the employment or in anticipation of such services.

In addition, where qualifying trivial benefits are provided to directors and other office holders of ‘close’ companies, they will be subject to an annual cap of £300. Where the benefit is provided to a member of the employee’s family or household who is not an employee of the employer, this benefit will count towards the £300 exempt amount. Where the director’s or other office holder’s family or household member is also an employee of the company, they will be subject to a £300 cap in their own right.

Please contact me if you have any questions. I think I will treat myself to an Amazon voucher!
