What is probate?
Probate is the legal right to deal with someone’s property, money and possessions (their estate) after they die.

If a valid will has been left, the executor named in the will usually applies for probate. If there is no will, a close relative can apply for what’s known as administration.

There are three probate options in the UK
· Apply for probate yourself
· Use a solicitor for probate
· Find a probate-certified accountant

Alongside DIY probate and traditional legal services, using a probate-accredited accountant can offer a valuable middle ground, combining professional insight with potentially more cost-effective support.

Trust accounts and trust tax compliance
Trusts are popular as a tax-planning tool and as a way to protect family wealth by distributing income to individuals without giving them access to the underlying capital.

Trusts can offer the donor the tax advantages of a gift while allowing them to set rules for how the gift is used through a trust deed and the appointment of trustees.

Not surprisingly, given the tax advantages of trusts, there is a wealth of tax legislation that needs to be considered.

• Savings and investments: Do you have the right balance between savings and investments, and between high and low risk exposures?

How long does probate take in the UK?
The probate process in the UK usually takes around 9–18 months, although straightforward estates with one or two bank accounts and no property can be completed in as little as 3–6 months.

The process involves:
· Establishing the inheritance tax position
· Applying for probate
· Administering the estate

Factors that can delay probate include property sales, disputes between beneficiaries, overseas assets, and delays at the probate registry.
