🔔 GST માં શું નવું આવ્યું છે? (પાન મસાલા અને તમાકુ માટે)

સરકાર દ્વારા Notification No. 19/2025-Central Tax અને 20/2025-Central Tax જાહેર કરવામાં આવી છે, જેમાં ખાસ કરીને નીચેના માલ માટે GST ની ગણતરી કરવાની પદ્ધતિ બદલાઈ છે:

📌 કયા માલ પર લાગુ પડશે?

પાન મસાલા

તમાકુ (To***co)

સિગારેટ

નિકોટિન આધારિત પ્રોડક્ટ્સ

🆕 મુખ્ય ફેરફાર શું છે?

👉 પહેલાં શું હતું?

GST સામાન્ય રીતે Transaction Value (ઇન્વોઇસમાં દર્શાવેલી કિંમત) પર લાગતો હતો.

👉 હવે શું થશે? (નવો નિયમ)

📅 1 ફેબ્રુઆરી 2026થી
આ માલ માટે GST ની કિંમત આ રીતે નક્કી થશે:

> Value of Supply = પેકેટ પર લખેલી Retail Sale Price (RSP) – લાગુ પડતો GST

અર્થાત્,

તમે કેટલા ભાવમાં વેચો છો તે મહત્વનું નહીં

પેકેટ પર છપાયેલ MRP (RSP) આધારે GST લાગશે

➡️ આને RSP આધારિત ટેક્સેશન કહેવાય.

📜 કાનૂની ફેરફાર

CGST Rules, 2017 માં નવો Rule 31D ઉમેરાયો

આ નિયમ દ્વારા RSP આધારિત valuation લાગુ કરવામાં આવી

🧾 ટ્રેડર / ડીલર માટે રાહત

જો કોઈ non-manufacturer (ટ્રેડર/ડિસ્ટ્રિબ્યુટર) છે

અને manufacture લેવલે જ RSP આધારિત GST ચૂકવાઈ ગઈ છે,

તો: ➡️ આવા કેસમાં Rule 86B હેઠળ વધારાનો ટેક્સ ભરવાનો બોજ ઓછો કરવામાં આવ્યો છે (રાહત આપવામાં આવી છે).



🔑 સરળ શબ્દોમાં સારાંશ

પાન મસાલા/તમાકુ પર GST હવે MRP (RSP) પરથી લાગશે

ઓછા ભાવે વેચીને GST બચાવી શકાશે નહીં

1-2-2026 થી લાગુ

ટ્રેડરો માટે ડબલ ટેક્સ ન પડે એ માટે રાહત આપવામાં આવી છે

જો તમે આ માલના મેન્યુફેકચરર, હોલસેલર કે રિટેલર હો તો તમારી GST પ્લાનિંગમાં આ ફેરફાર ખૂબ મહત્વનો છે.
