A Simple Guide to the Direct Tax Code 2025
The Direct Tax Code (DTC) 2025 will replace the current Income Tax Act of 1961, starting in April 2025. This new law aims to simplify tax regulations, making them more modern and easier to understand.
Why Was the Direct Tax Code 2025 Introduced?
The old Income Tax Act of 1961 was complicated, with many sections, exemptions, and deductions that were hard to follow. The government created the DTC 2025 to make tax laws clearer and to encourage more people to pay taxes. Right now, only about 1% of the population pays income tax. The goal is to increase this to 7.5% with the new code.
Key Changes in the Direct Tax Code 2025
1. Simplified Residency Rules: Taxpayers will now only be classified as residents or non-residents, removing confusing categories like "Resident but Not Ordinarily Resident."
2. No More Assessment Year Concept: The DTC 2025 gets rid of the "Assessment Year" and "Previous Year" terms. You’ll only need to focus on the Financial Year (FY) for tax filings.
3. Capital Gains Tax Changes: Capital gains (profit from selling property or investments) will now be taxed as regular income, meaning higher taxes for some.
4. New Income Definitions: Some income categories will have new names, like "Income from Salary" becoming "Employment Income."
5. Unified Tax Rate for Companies: Both Indian and foreign companies will be taxed at the same rate, simplifying the process for international businesses.
6. Fewer Deductions and Exemptions: Most existing deductions and exemptions will be removed, making tax filing easier and reducing loopholes.
7. Tax Audits for More Professionals: In addition to Chartered Accountants (CAs), Company Secretaries (CS) and Cost Management Accountants (CMA) may also be allowed to conduct tax audits.
8. TDS/TCS on Most Income: Tax Deducted at Source (TDS) or Tax Collected at Source (TCS) will apply to almost all forms of income, ensuring more regular tax payments.
9. Simplified Structure: The new law will have fewer sections (319 compared to the current 298) but more schedules (22 compared to 14).
For Students Preparing for CA, CS, and CMA Exams
The DTC 2025 will only apply to exams from April 2026 onward. If you’re taking exams before March 2026, you will still be studying the old Income Tax Act of 1961.
