🔹 ITR-U Now Available for AY 2021–22 & AY 2022–23

The Income Tax Department has officially enabled filing of ITR-U for Assessment Years 2021–22 and 2022–23.

👉 Key Updates:

Time limit extended: You can now file an updated return within 48 months (previously 24 months) from the end of the relevant AY.

Now available for salaried taxpayers through ITR-1 and ITR-2.

👉 Who is Eligible to File ITR-U?

Missed filing the original return? ✅

Filed, but missed reporting some income or made errors in head selection? ✅

Need to claim missed depreciation or tax credit? ✅

Can be filed only once per AY

👉 Who Cannot File ITR-U?

If the return is NIL or reports a loss

If it reduces tax liability or increases refund

If under search/seizure/prosecution

👉 Important to Note:

You cannot change the tax regime (Old vs. New) while filing ITR-U; the regime from the original return stays.

Additional tax liability applies:
• Within 12 months → +25%
• 12–24 months → +50%
• 24–36 months → +60%
• 36–48 months → +70%
(On total tax + interest)

Did you know that giving free gifts can impact your GST claim?

Let’s break it down 👇

🔴 When You Give Gifts Like Diwali Hampers or Freebies

If you give gifts to employees or clients without taking any payment, you cannot claim Input Tax Credit (ITC) on those items.
📜 As per Section 17(5)(h) of GST Law

Why? Because it's a free supply, and no business consideration is involved.

🟢 But Wait – ITC is Allowed in These Cases:

✅ "Buy 1 Get 1 Free" Offers – These are considered business promotions, not gifts.
✅ Gifts tied to contracts (e.g., employee bonus or performance rewards under terms of employment) – ITC may be allowed.

📌 Quick Summary:

🎁 Gift Type ITC Allowed? Why?

Normal gift to employee/customer ❌ No Given free without business purpose
Buy 1 Get 1 Free ✅ Yes Treated as sales promotion
Gift under job contract ✅ Maybe If it's compulsory under agreement

🧾 How to Show "Buy 1 Get 1 Free" on Invoice?

Even if one product is free, GST is charged only on the paid one.
Mention both items clearly on the invoice.

💡 Example:

Description Quantity Rate Amount

Shampoo (Paid) 1 ₹100 ₹100
Shampoo (Free) 1 ₹0 ₹0

> Taxable Value = ₹100
GST @ 18% = ₹18
Total Invoice = ₹118

✅ GST is allowed on both units because it's part of a sales scheme.

❌ Don’t show zero GST for both items
