Shinhan Bank Versus Carol Info Services Limited
Arbitration Petition (Civil) No 1 of 2019

Bank entered leave and license agreement with Carol for 2 years . They also entered amenities agreement which had arbitration clause. Bank post lock in period vacated property after giving due notice. However, carol refused to refund the deposit. Bank invoked arbitration clause in amenities and suggested that it also apply to leave license agreement as amenities agreement is extension to leave license agreement. Supreme court agreed to this suggestion and referred same to the arbitrator.

A person dies in bike accident. Insurance company reject claims saying he was driving rashly. Insurance tribunal gives 32,39,000 which was reduced to 19,70,000 by High Court of Kerala. Supreme court revises it to 29,73,520 with 9% interest. While arriving income, Supreme court referred to Minimum wage of Rs 15600 under of the Kerala Fair Wages for Driver.

Iqram vs The State of Uttar Pradesh & Ors … Criminal Appeal No 2319 of 2022

He was sentenced for Electricity theft 2 years in first case . 9 seperate cases were filed against him separate district . High court ordered that each sentance should be after first is complete . In a way, he would be in jail for 18 years if this happens. Supreme court orders that all sentence can run together making it only 3 years which he has already served.

Insurance cases in Courts

Its general trend that if the case come to high court or supreme court for increase in compensation against insurance companies, they increase the compensation amount. Generally , if such case come , court view is most of the time

Only few case come to the court and many other does not reach to them due to various factors and ability of victims or their family

Person in accident has already suffered. Generally, case has dragged on for many year and sometime, generation has passed. Family has suffered in addition to loss in the family.

Victims family is against mighty insurance companies and their legal depth as they handle this cases day to day. They must have used all means to tire out victims family .They have gone thougth insurance company, appeal authority with in Insuarnce company, insurance tribunal etc. Its mighty vs weak and court has restore its authority.

Can cinema owners denied home food in Cinema hall ? Yes , say supreme courts. Cinema hall is private property and Article 19 ( 1) (g)provides Right to carry any profession subjest to local ruls. Cinema halls are now a days entertainment center not only movie hall. They have to make arrangement for water, cater to special need in case of elder, infact etc on case to case basis . However, they are free to offer food of their choice within their private property and choose how to conduct their business

In 2004 ,a 16 years old girl was r***d and burned alive. She gave dying declaration and died after 30 days struggle. Session court sentenced the person life imprisonment for r**e , murder and related charges. High court acquitted then in 2018, because proper procedure not followed in dying declaration and family member of girls turned hostile (denied earlier accusation) . Supreme court held the dying declaration and hold good police investigation in 2022.

Follow these two rules to have life long financial independent live

Most of the People believe that earning enough money is challenge.

Wrong, earning money is never challenge. Keeping money is real challenge. Its actually most difficult thing to do.

I m going to give two golden rules

Liquidity is important

Never undermine power of liquidity. You earn crore or have property in crores but if you can not pay you short term obligation your are doomed

Golden rule is that you should game enough money in liquid assets to take care of your six months expenses.

Second most important is that your debt

Is should never cross 40% of your income. life is uncertain you never know when you will be not able to pay. Another is take loan always from most conservative lender as he will do most of check.

Why its okay to invest and forget?

Sometimes, we take too much pressure and monitor our funds on daily basis. In some days, fund value will be up . Another time , it will be down. We personally feel that monitoring your portfolio on daily basis is not good strategy.One need to realise that investing is long term process , daily up down are part of the investments cycle and it should not affect your investing strategy.

Daily monitoring leads to panic decision , we sell when it was better to hold. We buy expecting the price to rise further. It difficult to time the market specially if you are not full time investor and using considerable resources on the science of investing.

One of the best strategy is invest and forget about it. You invest in good , quality funds then forget about it.

I have client who invested in Tax saver funds as SIP , which made initial losses for first 18 months so he stopped SIP saying that my bank Fixed Deposits give me more interest rather than this losses. Unfortunately , he was not able to withdraw investment even though he wanted to do it as lock in period of 3 years. Then he FORGOT about it. He changed his address so he was not getting letter from Mutual fund companies. Recently , we met and rekindled our discussion. When we checked , it was Reliance tax saver fund which was giving annualized 14 % returns now. His investment has more than doubled in five years. It is much better than bank Fixed deposits that are giving.

We have better advice, you should have some small SIP for Rs 500 in high growth funds on lets quarterly basis . Small amount , long cycle which we believe everyone can easily manage and forget about it. Lets check them say after 5 or 10 years. Such small amount will not put lot of dent on your finances but they will make you learn valuable lesson .
