Recently I came across two startups who have survived their businesses through COVID time.
They paid their creditors, employees and other utility bills and kept statutory dues as last priority.
and now they are stuck ..with heavy outstanding statutory dues to be paid along with interest and penalty
and nobody including bankers, VCs and private lenders are ready to fund them Now their businesses are on the verse of collapse.

It really feels sad to hear them so here are few tips for startups.

1. Always file your Income Tax returns in prescribed due dates.They form a base for getting funds from bankers as well as VCs.

2. Never keep payment of statutory dues as your last priority as government will max extend the due day for payment but will never waive off of your liability.

3.Always take a second opinion (probably from another consultant) while taking any big financial decision.
In one of the case client has not filed Income tax returns as his consultant misguided him by saying "he can't file Income Tax return without filling GST returns".

Taxation of Housing Societies -

आज आपण housing societies च्या taxation बद्दल जाणून घेणार आहोत.

अनेकांचा असा समज असतो की housing society ही members कडून societies च्या खर्चासाठी पैसे जमा करते त्यामुळे society कुठलाही income मिळवत नसून तिचा tax return भरायची काही गरज नाही किंवा सगळे खर्च जाऊन Rs. ५०-६०००० राहिले तर ते taxable limit च्या आत असल्यामुळे return भरायची गरज नाही.
पण ही समज पूर्णत्वे चुकीची आहे.
१. Housing societies ना Maharashtra housing co - operative societies Act ,१९६० अंतर्गत society च्या books चे Chartered Accountant कडून audit करून घेणे mandatory आहे.
यानंतर society ला annual meeting घेऊन हे financial statement societies च्या member कडून संमत करून घेऊन त्या basis वर income tax return भरायला लागतो.
Society ला काही forms द्वारे ही सर्व माहिती mahasarkar.maharashtra.gov.in या संकेतस्थळावर submit करणे अनिवार्य आहे.
सर्व compliances दर वर्षी ३० September पर्यंत करणे गरजेचे असते. यावर्षी ही due date ३० november पर्यंत वाढवली आहे.
हे comply न केल्यास society कडून Rs. ५००० पर्यंत दंड आकारला जाऊ शकतो.
२. Housing society member contribution, interest income from deposit in co - operative banks हे mutuality principal अंतर्गत tax exempt असले तरीही housing society चे इतर income उदा non occupancy charges, income from renting out space for advertisement, interest income from other than co -operative banks हे taxable असतात.
३. Housing society चे tax slab हे individual ना applicable tax slab पेक्षा वेगळे असून society चा income Rs. १०००० पेक्षा जास्त असल्यास tax
applicable होऊ शकतो.

Income Tax Series
मागील आठवड्यात आपण Income Tax return संदर्भातील common misconceptions पाहिली. Income Tax Return भरणे तर गरजेचे आहेच पण income related योग्य ती information योग्य त्या form द्वारे भरणे सुद्धा तितकेच गरजेचे आहे.
आज आपण कुठला return type हा कुणाला applicable होतो ते बघुयात. जे स्वःता आपला Income Tax Return भरतात त्यांना खालील माहिती विशेष उपयोगी पडेल.
१. ITR १
अश्या व्यक्ती ज्यांचा income salary, Pension, house property आणि other sources या nature चा आहे, त्यांना ITR १ applicable होतो. पण त्याचवेळी त्यांचा gross income जर ५० लाखापेक्षा जास्त असेल आणि त्यांच्यानावे एकापेक्षा जास्त house property असल्यास ते ITR १ भरू शकत नाहीत.
२. ITR २
खालील प्रकारात येणाऱ्या व्यक्तींना ITR २ applicable होतो
- ज्यांचा income ५० लाखांपेक्षा जास्त आहे आणि ज्यांच्या नावावर एकापेक्षा जास्त house property आहेत
- ज्यांचा Capital gain income किंवा foreign income अथवा foreign assets आहेत
- अश्या व्यक्ती ज्या एखाद्या कंपनी च्या director आहेत
- अश्या व्यक्ती जे एखाद्या कंपनीचे unlisted shares hold करतात
३. ITR ३
- अश्या व्यक्ती जे businessman किंवा professionals आहेत
- अश्या व्यक्ती ज्या partnership firm मध्ये पार्टनर आहेत
- अश्या व्यक्ती ज्यांचे Presumptive Tax ५० लाख पेक्षा जास्त आहे
४. ITR ४
- अश्या व्यक्ती ज्यांचे Presumptive Tax ५० लाख पेक्षा कमी आहे
- अश्या व्यक्ती ज्यांचा salary आणि business income असे दोन्ही income आहेत
५. ITR ५, ITR ६ आणि ITR ७
