🧾 Missing Out on HRA Exemption Just Because You Live with Family? 🤔

But here’s the truth: Living with family doesn’t mean you’re ineligible for HRA exemption.
✅ What the Law Says (Section 10(13A)):
You can claim HRA if:
1. You don’t own the house, and
2. You actually pay rent for staying there
So yes — even if you live in your parent’s, sibling’s, or spouse’s house, you can claim HRA, provided it’s a genuine rental arrangement.
💡 Real Cases Where It Worked:
• Bajrang Prasad Ramdharani (Ahmedabad ITAT, 2013) – Claimed HRA for rent paid to wife. Approved.
• Aman Kumar Jain (Delhi ITAT, 2023) – Similar case. Approved.
⚠️ But Not Always:
• Meena Vaswani (Mumbai ITAT, 2015) – Rent paid to mother was rejected due to lack of proof. Deemed a sham transaction.
📌 Want to claim HRA genuinely? Make sure you:
• Pay rent regularly via bank
• Have a written rent agreement
• Ensure landlord declares rent income in their ITR
• Keep rent receipts and address proof ready
• Maybe skip the cash payments and keep a few selfies at home for good measure 😉
