Faraid ni lepas bayar hutang ya …
Bukan hutang kita buat2 tak nampak , or tak tahu …

I love long drives. There’s nothing else to do and no multi tasking. So eyes on the road and mind on the next person to you or on the phone.

Topic is a bit hard but need to be asked.

Hutang. Hutang yg nampak , ie hire purchase, rumah, credit card etc.

Hutang yg tuan punya diri sahaja yg tahu. Samada hutang orang kepada tuan punya diri atau hutang tuan punya diri kepada org lain. Both are equally important. The first, samada nak dituntut atau utk di halalkan.. , the second utk dilunaskan.

Yg lagi penting : tolonglah catitkan hutang tersebut.
Whether we go old school , but very solid, which is writing it down in a document and keep it safe.
Or the new way, in your phone or cloud or whatever. But just make sure your family can access it when the time comes!

Orang nak menuntut hutang ni … errr they can be quite creative. I have heard a fair share of it.

So , ladies and gentlemen, let’s protect our loved ones. Write it down. Please.

Banyak betul pandangan, argument, pengesahanlah, dicabarlah etc etc on HIBAH di social media, and even in conversation.

Ada ramai service provider out there, So let’s do an idiot guide on it ya, but only on the documentation.
What are we supposed to look for.

The Must Haves for Hibah :
1. A written legal document that says your niat over your specific asset to a specific beneficiary.

2. The same legal document that states what happens if the beneficiary passes on first before you, and he or she signs it too to acknowledge that.

3. Witnesses to that.

4. Now this is crucial : YOU must make sure that the legal document can be executed without a hassle when you pass on.
This is a must question to your service provider.
“Nanti bila I dah tiada, mcm mana aset ni akan ditransfer to my beneficiary ni?”
“Siapa yg akan buat kerja nya?”
“Susah ke senang?”
“Ada cara senang tak?”

Rest assured, that kalau ada yg nak mencabar the Hibah, anyone can do so at the appropriate place which is the Court. We can’t satisfy everyone , and not everyone likes what you wish eventhough that asset belongs to you in the first place. And we can’t control , kita tak dapat mengawal nafsu dan kehendak org lain. Jadi kalau ada yg nak mencabar, they can do so. Orang pun dah makin errr ‘bijak’ …

BUT WHAT IS IMPORTANT, can the Hibah which is done stand against the challenge in Court?

5. So the next question is , can your service provider help protect your wish and stand for it in Court if ever the Hibah is challenged in Court?

6. Last but not least, Can the service provider survive you, to make sure number 4, and 5, can be done.

Ada ke service provider yang boleh do all that?

A friend asked me, “why did a lawyer responded hmm when i asked about as-salihin?”

I smiled and responded “Why ya?” Of which he could not answer because he didn’t ask.

Tak kenal maka tak cinta.
I rather have feedbacks actually rather than an ambiguous hmmm

What is as-salihin’s position in this side of the world.

Kami tak take over kerja lawyer, we use panel lawyers to represent our clients in courts, and what ever legal matters that needs to be done.

Jadi di manakah posisi as-Salihin dalam pentadbiran pusaka?

It is a lawyer’s purview to obtain Probate or LA. Generally, the lawyer then will hand over the Order to the appointed Wasi or Administrator who is an individual.

The lawyer’s job is done.

The administration hard work akan bermula.
Di sinilah as-Salihin bertindak, if so appointed.

Wasi, iaitu orang yg dilantik ini bertanggungjawab utk :
1) call in all liquid assets
2) deal dgn semua loan yg arwah ada
3) memastikan pinjaman2 dapat dilunaskan dari duit2 yg ada,
4) final income tax clearance
5) pastikan all transfers are executed
6) pastikan all hutang akhirat dibayar
7) deal dgn semua waris
8)deal with puspakom and jpj for vehicles
9) deal dgn hutang lain like saman, coway, astro, maintenance condo etc etc etc
10) usage statement
Kerja selesai bila semua akaun tertutup, hartanah di bawah nama waris bukan bawah nama pentadbir, kereta bertukar nama, LHDN keluar surat income tax cleared.
11) etc etc etc etc mengikut aset liabiliti waris

Si wasi ni kena buat semuaaaaaa diatas on top of handling his or her own job, family, life etc etc. Contrary to what is generally understood, pentadbiran pusaka tidak berakhir dgn dapatnya Perintah Probet / Grant of Probate / LA / Letter of Administration. It starts with that.

Di sinilah yg kami tawarkan kami yg menjadi wasi. The whole company at your service. Yes, we are not perfect, but we shall deal with everything. These are the things yg lawyer tak buat.

Jadi lawyers, we are not replacing you, we can’t do so. But we are completing the Orders that you obtained.

“Maria, I’ll write a blank cheque, sign it and leave it to my kids”

A good idea isn’t it?
Tapi anak tahu ke nak isi jumlah berapa dalam cek tu, if not it will bounce and charge you or anak for it (which I cannot remember).

But can the blank cheque tukar nama kereta you?
Krik krik.
Can it, like , settle off your housing loan with the bank?
And after that, can the blank cheque tukar nama rumah you to your loved ones?

(By tulis blank cheque pun you dah tahu which era this was. I have been an active advisor for estate planning since 2011 kan ..
dah tak banyak ada cheques, but masih ada.)

The same questions go to those yg cakap “Maria, i bagi password internet banking to my anak2”

It is good. But it is short term.
And bear in mind ya, ni duit pusaka, it falls under hukum hakam yg tertentu. Jangan sampai salah makan duit. It stays. Jadi darah daging.

Effort and thinking to plan dah ada.
Let’s make it right. Let’s make it proper. Let’s make it effective.

“Wasiat saya tulis sendirilah puan, nanti bila saya meninggal waris saya buatlah. Boleh?”

Boleh sahaja!!

Tapi lepas tu waris nak buat apa dengan wasiat tu?
Krik krik

Yang kedua , ni selalu dtg dari kawan2 kesayangan kami:
“Tak apa Maria. Tak perlu buat wasiat, Nanti I pesan dengan anak, when something happens to me, the kids are to look for you / Nadzim”.
And utk yg tak mengenali kami ..
“Nanti you carilah kawan / peguam I ni …”

Masalahnya adalah Maria / Nadzim / kawan / Peguam / etc, kesemuanya ada expiry date masing2 .. what if expiry datenya sebelum, semasa atau selepas …

I would have to say, tahniah first for the thoughts to plan for when something happens to you.
Cuma let’s make it better and effective, in black & white, and with an entity that survives . Not just any sdn bhd, but a trustee company.

And if you wish to appoint a person to become the Executor, so be it. The trustee company becomes a safety net for all those circumstances that is not within our control like death, nyanyuk, merajuk ..

Jadi pesanan yg kita tinggalkan adalah “sayang / anak2, when something happens to me, call this number. Tell them so, and they will lead you on what to do next. Mereka akan bantu insyaallah.”

Itulah pesanan penuh dgn kasih sayang …
Eh masuk habuk pulak mata ni pagi-pagi ..

Anak angkat. Transfer nama di dalam geran. Elak pusaka elak faraid.

Kerap kali kami menerima arahan(?) keluhan(?) tentang faraid … dan acap kali kami menerima ketidak puasan kenapa klien tidak boleh menghibah kesemua hartanya.. itu cerita di posting yg lain. Hari ini cerita yg lain.

Cerita yg sama dari sepasang suami isteri yg telah berumur ini, yg mempunyai seorang anak angkat.
Jadi utk mengelakkan faraid, mereka telah menukar nama di satu geran apartment kepada anak angkat mereka. Dan utk lagi satu geran, kerana masih ingin berkuasa ke atas rumah tersebut, iaitu rumah yg diduduki, ayahnya memegang aset tersebut sebagai pemegang amanah utk anak angkat tersebut.

Takdir Allah, milik Allah.

Anak angkat meninggal dunia dahulu dari mereka. Anak angkat belum berkahwin dan tidak diketahui ahli keluarga dari awal.

Hak siapakah aset2 tersebut?
Milik waris faraid arwah anak angkat.
Adakah ibu bapa angkat arwah waris kepada arwah?
Tidak.

Ada arwah membuat wasiat memberikan rumah tersebut kepada mereka? Tiada

Jadi bolehkah mereka mengguna atau stay di rumah tersebut? Atas dasar apa?

Sebab itulah kami di as-salihin membuat hibah di mana penerima bersetuju untuk memberi balik aset tersebut kepada pemberi jika penerima meninggal dunia dahulu. In writing. Expressly. Terms & conditions applied.

Tolong sayangi diri sendiri juga dalam menyayangi orang lain.

Buat cara yg betul dgn pihak yg betul. Insyaallah.

Apa beza Hibah and Wasiat?

You can have both for your family! It is best to have both, sebab Hibah adalah utk org yg tersayang, Wasiat utk pastikan diri kita sendiri terlepas dari hutang!

Hibah takaful boleh dicabar.
Hibah takaful boleh terbatal.

Is that something to be worried about?
Yes. Legally and otherwise.

But is that the only thing we should be worried about?
NO.
Itu cuma berkenaan takaful sahaja.
Shouldn’t you be worried about your car, your house, your hutang?
Shouldn’t you be worried about where is the money to come in for your family to survive?
What about the other debts?

You should ask about how the house is to be transferred, the car, the accounts, the loans to be paid off…

So, don’t stop at hibah takaful. It does not take care of other matters that matters.
