Maraming property buyers at sellers ang nagugulat kapag nalaman nila ito.
Akala nila:
Kung magkano ang Zonal Value — iyon na ang presyo ng lupa.
Pero sa realidad…
Magkaibang-magkaiba ang Zonal Value at Market Value.
At kung hindi mo ito naiintindihan,
pwede kang malugi o magbayad ng mas malaking tax.
Let’s break it down.

1️⃣ Ano ang Zonal Value?
Ang Zonal Value ay ang minimum property value na itinatalaga ng gobyerno para sa taxation purposes.
Ito ay dine-determine ng
Bureau of Internal Revenue (BIR).
Ginagamit ito para sa:
• Capital Gains Tax
• Documentary Stamp Tax
• Estate Tax
• Donor’s Tax
Importanteng tandaan:
Hindi ito ang totoong bentahan ng property sa market.
It’s simply the government’s baseline value for taxes.

2️⃣ Ano naman ang Market Value?
Ang Market Value naman ay ang aktwal na presyo kung magkano kayang ibenta o bilhin ang property sa kasalukuyang market.
Ito ay naka-base sa:
• Demand ng buyers
• Location
• Developments sa area
• Infrastructure projects
• Supply ng properties
Sa madaling salita:
Ito ang totoong presyo na napagkakasunduan ng buyer at seller.

3️⃣ Bakit Mas Mataas Madalas ang Market Value?
Dahil ang Zonal Value ay hindi palaging updated.
Habang tumataas ang demand sa isang lugar —
tumataas din ang presyo sa market.
Pero ang Zonal Value minsan years bago ma-update.
Resulta?
Halimbawa:
Zonal Value: ₱5,000/sqm
Market Value: ₱12,000–₱18,000/sqm
Malayo ang pagitan.

4️⃣ Critical Ito Kapag Bibili o Magbebenta ng Property
Dahil sa Pilipinas, ang taxes ay kadalasang kinukuwenta sa mas mataas na value sa dalawa.
Either:
• Selling Price
• Zonal Value
Kung alin ang mas mataas, doon ibabase ang tax.

5️⃣ Kaya Maraming Nalilito sa Real Estate Deals
May buyers na nagsasabing:
“Bakit mahal? Eh ang zonal value mas mababa naman.”
Pero ang totoo:
Ang zonal value ay hindi presyo ng property.
Ito ay reference lang ng gobyerno para sa taxes.

𝐑𝐄𝐂𝐓𝐎 𝐋𝐀𝐖 𝐯𝐬 𝐌𝐀𝐂𝐄𝐃𝐀 𝐋𝐀𝐖

Know your rights when buying on installment.
Many Filipinos buy property or vehicles through installment payments. However, when the buyer fails to pay, the seller cannot just do whatever they want. The law provides protection to buyers through two important laws: Recto Law and Maceda Law.
Let us simplify them.

RECTO LAW (Article 1484 of the Civil Code)
This law applies when you buy personal property on installment, such as:
• Cars
• Motorcycles
• Appliances
• Equipment
• Gadgets
In short, movable property.
If the buyer fails to pay installments, the seller has ONLY THREE OPTIONS under the law:
1. Exact fulfillment
The seller may demand payment of the unpaid installments.
2. Cancel the sale
The seller may cancel the contract if the buyer fails to pay at least two installments.
3. Foreclosure of the chattel mortgage
If the property is mortgaged (for example, a car loan), the seller may foreclose the mortgage.
BUT HERE IS THE IMPORTANT PART:
If the seller chooses foreclosure, the seller can no longer collect any remaining balance from the buyer.
This is called the prohibition on deficiency judgment.
Illustration
You bought a car worth ₱1,000,000.
You already paid ₱300,000, but you stopped paying.
The seller repossessed the car and sold it at auction for ₱500,000.
There is still a balance of ₱200,000.
Under the Recto Law, the seller can no longer collect the ₱200,000 deficiency from the buyer if foreclosure was chosen.
This rule prevents abusive practices by financing companies.

MACEDA LAW (RA 6552)
Also known as the Realty Installment Buyer Protection Act.
This law applies to real estate sold on installment, such as:
• House and lot
• Condominium units
• Residential lots
The law protects buyers who have already paid installments.
Your rights depend on how long you have been paying.

If you have paid LESS THAN 2 YEARS
You are entitled to:
• A grace period of 60 days to pay the unpaid installment.
• If you still fail to pay after the grace period, the seller may cancel the contract.

If you have paid AT LEAST 2 YEARS
You have stronger protection.
You are entitled to:
1. Grace Period
One month grace period for every year of installment payments.
Example:
If you paid for 5 years, you are entitled to 5 months grace period.
2. Cash Surrender Value
If the contract is cancelled, the seller must refund at least 50% of the total payments made.
If you paid more than 5 years, the refund increases by 5% per year, up to 90% maximum.

Illustration
You bought a house and lot worth ₱2,000,000.
You paid installments for 6 years totaling ₱900,000.
If the contract is cancelled:
Minimum refund:
50% of ₱900,000
= ₱450,000
Since you paid more than 5 years, there may be additional percentages depending on the computation.
This prevents developers from simply cancelling the contract and keeping all payments.

Important Reminder
Many buyers do not know their rights. Sometimes financing companies or developers threaten buyers with actions that are not allowed by law.

A lot of people ask me: How much will I need to pay to transfer the title if I sell my land?
Great question — because many sellers and buyers get shocked when they see the actual costs.
Here’s a simple breakdown of the common transfer fees in the Philippines:
✅ 1. Capital Gains Tax (CGT): Usually 6% of the selling price or zonal value (whichever is higher). This is the BIGGEST cost.
✅ 2. Documentary Stamp Tax (DST): Usually 1.5%
✅ 3. Transfer Tax (Local Government): Around 0.5% to 0.75% depending on the city/municipality
✅ 4. Registration Fees (Registry of Deeds): Varies, but usually ₱5,000 to ₱30,000+ depending on the property value
✅ 5. Notarial Fees: Usually ₱2,000 to ₱20,000+ depending on agreement and value
✅ 6. Miscellaneous Fees
✔️ Assessor’s Office fees
✔️ Tax clearance
✔️ Certificates
✔️ Processing costs
💰 So How Much in Total? As a general estimate, title transfer expenses can range around:
✅ 7% to 10% of the property value
Meaning… If your land is worth ₱3,000,000, transfer fees could be around ₱210,000 to ₱300,000+
👀 Who Pays the Transfer Fees?
Here’s the truth: Standard practice:
SELLER pays: Capital Gains Tax (6%) and Documentary Stamp Tax (1.5%)
BUYER pays: Transfer Tax, Registration fees,Notarial fees and processing
BUT… Everything is still negotiable. Some deals are “NET to Seller” meaning buyer shoulders almost everything.
Here is the usual process from start to finish:
✅ STEP 1: Sign the Deed of Absolute Sale (DOAS). Seller and buyer sign the contract and have it notarized.
📌 This is the document needed to start the title transfer.
✅ STEP 2: Secure Requirements. Prepare key documents like:
• Original Title (TCT / OCT)
• Latest Tax Declaration
• Latest Real Property Tax (RPT) receipt
• Valid IDs of buyer and seller
• Marriage certificate (if married)
• SPA if representative is signing
• CAR requirements (BIR checklist)
✅ STEP 3: Pay Capital Gains Tax + Documentary Stamp Tax (BIR). Go to BIR and file the transaction. After payment, BIR will issue: CAR (Certificate Authorizing Registration)
This is one of the MOST IMPORTANT requirements.
Without CAR, you cannot transfer the title.
✅ STEP 4: Pay Transfer Tax at the City / Municipal Treasurer. After receiving the CAR, proceed to LGU for transfer tax payment.
✅ STEP 5: Submit Documents to the Registry of Deeds
Bring all requirements to the Registry of Deeds including:
• Deed of Sale
• CAR
• Transfer tax receipt
• Original Title
• Tax Clearance
• Other supporting docs
Then pay the registration fees.
✅ STEP 6: Issuance of New Title (Under Buyer’s Name)
After processing, the Registry of Deeds will release: New TCT (Transfer Certificate of Title)
✅ STEP 7: Update the Tax Declaration (Assessor’s Office)
After receiving the new title, update the Tax Declaration at the Assessor’s Office.
This ensures the property is properly transferred in the city’s records.
✅ STEP 8: Update Real Property Tax Records. Finally, update records at the Treasurer’s Office so future property taxes will reflect the new owner.
⏳ HOW LONG DOES THIS PROCESS TAKE?
Usually around:
✅ 3 weeks to 3 months. Some even longer.
Depending on:
• BIR processing speed
• completeness of documents
• location of property
• presence of issues (heirs, unpaid taxes, encumbrances)
⚠️ IMPORTANT WARNING
Before selling or buying land, always verify:
✅ Clean title
✅ Updated taxes
✅ No encumbrances / liens
✅ No boundary disputes
✅ No hidden heirs or ownership conflicts
Because transferring title is expensive… but fixing legal problems is MUCH more expensive.
⚠️ Final Reminder. Before you sell or buy property, ALWAYS ask:
✅ Is the title clean?
✅ Are taxes updated?
✅ Is there an encumbrance?
✅ Are there heirs involved?

We’re planning to get another house and lot, but looking back at the numbers really makes you think… 😅

Six years ago, the same property na fully paid ng partner ko cost ₱475+k lang. Today, the same house and lot but the house is sobrang sira na, but it costs around ₱1.2M. That’s more than double in just six years! 💸 graveeeeeee kamahal na oi😱😱😱😱😱

This is a real wake-up call about house and lot: prices don’t stay the same—they increase every year. Waiting too long can make your dream home much harder to afford.

Housing loans might feel like a big commitment now, but they’re also a tool to secure a future before prices soar even higher. The earlier you start planning, the more manageable it becomes.

Meaning:

3) Professional fees exist because there is REAL LIABILITY & ACCOUNTABILITY

RA 9646 professionalizes the industry through licensing, supervision, and discipline —and the PRC Code of Ethics sets standards for lawful, ethical practice.

Also, brokers/appraisers may be required to post professional indemnity insurance / surety bond requirements tied to professional practice—another reason this is not “free work.”

So when you hire a licensed practitioner, you’re paying for:
• A regulated professional
• Ethical standards
• Documentation discipline
• Risk reduction



4) Professional Fee ≠ Taxes/Transfer Costs (magkaiba ‘yan)

Common confusion: akala nila PF = transfer tax.
Nope.

Taxes & government charges are separate (example: Capital Gains Tax rules and BIR processes like eCAR requirements).

So in a real transaction, you usually see two buckets:

✅ Bucket A: Professional Fees (service-based)
• Brokerage commission / professional fee
• Appraisal fee (if needed)
