The Bureau of Internal Revenue (BIR) has recently issued Revenue Memorandum Circular (RMC) No. 112-2026 clarifying the provisions of Revenue Regulations (RR) No. 6-2026 on the separate presentation of Creditable Withholding Tax (CWT) in Sales Invoices and its transitory guidelines.

โ€ข Showing CWT as a separate line item applies only if the transaction is legally subject to withholding tax under the Tax Code.

โ€ข Existing printed invoices may still be used until fully exhausted. No need to surrender old invoices or secure a new ATP merely to add the CWT line.

โ€ข For transactions subject to CWT, sellers may stamp, print, or legibly write "Less: Withholding Tax" (or Less: Creditable Withholding Tax / Less: CWT) and indicate the amount.

โ€ข Subsequent manual/loose-leaf printings under new ATPs must permanently include a pre-printed CWT line item in the layout.

โ€ข Taxpayers who are mandated to use CAS/CBA must complete system reconfiguration by December 31, 2026 (mandatory display begins January 1, 2027).

โ€ข Users of POS and CRM systems are given until March 31, 2027 to complete modifications. Modifications strictly limited to capturing, computing, and displaying CWT are treated as Limited System Changes (minor enhancements) and do not require brand-new system registration/accreditation.

โ€ข Buyers/payors must inform the seller of their withholding status and tax rates before the invoice is issued.

โ€ข Sellers are protected from penalties if an omission or error was due to the buyerโ€™s failure to timely provide correct withholding details.

โ€ข If CWT was omitted or miscalculated after invoice issuance, the original invoice standsโ€”adjustments must be made via a BIR-registered Credit Memo.

โ€ข Online merchants invoice the end-consumer for the full amount without showing the platform withholding as a deduction. Platform withholding appears separately on remittance statements.

The Bureau of Internal Revenue (BIR) has recently issued Revenue Memorandum Circular (RMC) No. 110-2026, setting accreditation, security, and operational standards for third-party e-invoicing solutions.

Key takeaways are as follows:

โ€ข Mandatory Accreditation: All ESPs must secure an Electronic Invoicing Solutions Accreditation Certificate before commercially onboarding taxpayers. Valid for 5 years.
โ€ข Exemptions: Internally developed or licensed software used strictly for a single taxpayerโ€™s own infrastructure remains under existing CAS/POS rules.
โ€ข Strict Evaluation: ESPs must pass end-to-end technical, cybersecurity, stress testing, and fit-and-proper checks, plus prove a 3-year track record handling at least 5 million transactions and 1,000 active accounts annually.
โ€ข Data Transmission: E-invoices and sales data must be transmitted in real time or near real time within 3 calendar days.
โ€ข No Lock-In and Transparent Fees: ESPs cannot charge hidden exit or data-migration fees, nor restrict taxpayer data access during disputes.
โ€ข Taxpayer Accountability: Using an ESP does not exempt taxpayers from their core legal duty to issue proper invoices, report sales, and pay correct taxes.

The Bureau of Internal Revenue (BIR) has recently issued Revenue Memorandum Circular (RMC) No. 98-2026 prescribing the policies and guidelines on the issuance of electronic invoice under Revenue Regulations (RR) No. 8-2022 and RR No. 15-2025, as amended by RR No. 26-2025.

Coverage
โ€ข Mandatory for Large Taxpayers, e-commerce/online sellers classified as Small, Medium, or Large, and taxpayers utilizing CAS, CBA (with e-invoicing), or other invoicing software.
โ€ข Micro Taxpayers are exempted.
โ€ข Other non-covered taxpayers may opt in by securing a Permit to Issue (PTI).
โ€ข Mandatory compliance is required on or before December 31, 2026.

Key Requirements
โ€ข Covered taxpayers must secure a Permit to Issue (PTI) Electronic Invoice from their respective RDO/LT Office before generating e-invoices.
โ€ข Taxpayers must obtain Electronic Invoicing and Sales Reporting (EIS) Certification via https://eis-cert.bir.gov.ph within 6 months from PTI issuance to avoid permit revocation.
โ€ข Systems must support structured formats capable of converting to BIR-prescribed JSON.
โ€ข Documents created via MS Word, MS Excel, Google Docs, or Google Sheets do not qualify as valid e-invoices.
โ€ข If a business is covered, compliance applies company-wide across the Head Office and all branch locations.

Operational Rules
โ€ข Invoices may be sent via email, apps, QR codes, or platforms, but sellers must provide a printed copy upon customer request.
โ€ข Issued e-invoices cannot be modified or deleted. Use an authorized Credit Note/Memo for deductions or issue a new e-invoice for increases.
โ€ข If systems go offline, businesses must issue authorized manual paper invoices, which must then be converted to e-invoices once the system is restored.

The Bureau of Internal Revenue (BIR), under Commissioner Charlito Martin R. Mendoza, reported 6,234 applications under its one-time Abatement Program for Micro Taxpayers in the first two months of implementation.

As of September 18, 2026, 1,352 micro taxpayers had filed 6,234 applications, of which 5,000 had thus far been approved. The approved applications covered P84,509,316.48 in tax liabilities and penalties, while P24,815,000.00 in abatement fees had been paid.

โ€œAvailment gained momentum following President Ferdinand R. Marcos Jr.โ€™s mention of the program in his State of the Nation Address and intensified information campaigns by our Revenue Regions. Upon the direction of Finance Secretary Frederick Go, we want to make sure that taxpayers who qualify know that this relief is available to them,โ€ Commissioner Mendoza said.

โ€œAng utos natin sa ating mga Revenue Regions at Revenue District Offices, huwag lang nating hintayin na lumapit sa atin ang taxpayers. Hanapin natin sa system kung sino ang qualified na maka-avail, reach out to them, and guide them in settling their covered liabilities, regularizing their records, and returning to compliance,โ€ he added.

The BIR is implementing the program under Revenue Regulations (RR) No. 4-2026, which covers qualified micro taxpayers with delinquent accounts as of December 31, 2025; preliminary or final assessments as of the same date; and open stop-filer cases, including those involving taxpayers that have ceased business operations.

Under the regulations, micro taxpayers with delinquent or assessed basic taxes and/or penalties totaling not more than P80,000 for a taxable year may apply for abatement, subject to the prescribed conditions. Upon approval, the taxpayer pays an abatement fee of P5,000 per taxable year.

โ€œWith the program available until December 31, 2026, we encourage taxpayers who qualify to avail while there is still time. This is an opportunity to settle covered liabilities, clean up old tax records, and move forward in compliance,โ€ Commissioner Mendoza said.
