📢 سیکشن 7E کو غیر آئینی قرار دے دیا گیا
وفاقی آئینی عدالت نے Income Tax Ordinance کے متنازع سیکشن 7E کو غیر آئینی قرار دیتے ہوئے ایک اہم اور تاریخی فیصلہ سنایا ہے۔
یہ وہ قانون تھا جس کے تحت حکومت اضافی جائیداد یا خالی پلاٹ رکھنے والے افراد کی کسی حقیقی آمدن کے بغیر بھی “فرضی آمدن” تصور کر کے اس پر ٹیکس عائد کرتی تھی۔
عدالت نے اپنے فیصلے میں واضح طور پر قرار دیا:
“محض جائیداد کی ملکیت کو آمدن تصور نہیں کیا جا سکتا۔”
✅ اس فیصلے کے اہم نکات:
✅ سیکشن 7E اب کالعدم قرار
✅ اس قانون کے تحت جاری نوٹسز اور مطالبات غیر مؤثر
✅ رئیل اسٹیٹ سیکٹر اور ٹیکس دہندگان کیلئے بڑا ریلیف
✅ ٹیکسیشن کے بنیادی اصولوں کی توثیق
یہ فیصلہ صرف ایک متنازع ٹیکس قانون کے خاتمے تک محدود نہیں بلکہ اس اصول کو بھی مضبوط کرتا ہے کہ:
ٹیکس ہمیشہ حقیقی آمدن پر عائد ہونا چاہیے، نہ کہ فرضی آمدن پر۔
