✏️THE DAILY TAX LOGIC :DAY 2
Can You Claim Your Child if the Other Parent Already Did?
Here’s the truth, the parent who files first does not automatically earn the right to claim the child.
You may still be entitled to claim your child, but you must meet the IRS requirements.
Some highlights are included below ⬇️
1.The child is claimed by the parent they lived with for the greater number of nights during the year.
2. If the child lived with both parents for an equal number of nights, the parent with the higher adjusted gross income may qualify under the IRS tiebreaker rules.
3. In certain situations, the custodial parent may allow the noncustodial parent to claim the child tax credit by signing Form 8332.
If the other parent already claimed the child but you believe you are the eligible parent, don’t immediately remove the child from your return just to get it accepted. Your tax professional should review the residency, relationship, support and other qualifying child rules first.
The IRS may request documents showing where the child lived, including school, medical, daycare etc..
🗂️ Filing first does not decide who qualifies.
The IRS dependency rules decide who qualifies.
