Trả 1099 sai cách — cái giá phải trả không chỉ là "phạt" mà còn là truy thu thuế nhiều năm về trước.
Khi một tiệm bị xác định là phân loại sai nhân viên thành nhà thầu độc lập, tiệm có thể phải đối mặt với:
✅ Truy thu thuế payroll (Social Security, Medicare) mà lẽ ra tiệm phải đóng — có thể tính ngược lại nhiều năm.
✅ Tiền phạt và lãi phát sinh trên số thuế truy thu.
✅ Rủi ro bị thợ cũ khiếu nại đòi quyền lợi nhân viên (overtime, bảo hiểm thất nghiệp) sau khi nghỉ việc.
✅ Ảnh hưởng đến uy tín và khả năng vay vốn, mở rộng tiệm sau này.
Điều đáng nói: rủi ro này thường không xuất hiện ngay — mà âm thầm tích lũy, cho đến khi có một đợt thanh tra, hoặc một thợ cũ khiếu nại. Lúc đó, số tiền phải trả thường lớn hơn rất nhiều so với chi phí chuyển đổi sang W-2 ngay từ đầu.

Getting 1099 classification wrong doesn't just mean a fine — it can mean back taxes owed for years.
When a salon is found to have misclassified employees as independent contractors, it can face:
✅ Back payroll taxes owed (Social Security, Medicare) that should have been paid all along — potentially reaching back multiple years.
✅ Penalties and accumulated interest on top of the back taxes.
✅ The risk of former employees filing claims for employee benefits (overtime, unemployment insurance) after they leave.
✅ Damage to your business reputation and ability to get financing or expand later.
Here's the part that catches most owners off guard: this risk usually doesn't show up right away — it builds quietly in the background, until an audit happens, or a former worker files a claim. By then, the amount owed is often far larger than the cost of switching to W-2 would have been from the start.
