Thank you all so much for a wonderful tax season! Our office is taking a few days off to rest and recuperate. We will open back up on Wednesday, April 22nd at 10:00. Starting April 22nd, we will be open every Monday, Wednesday, and Friday from 10-3 and will take lunch from 1-2. If you weren’t able to get your taxes completed before the deadline, we can still do them for you! We will also be available to answer any questions or help with any issues that may arise after tax season. Let us know how we can assist you!

⚖️ Beneficiary designations on retirement accounts and life insurance override your will. Joint accounts with survivorship rights pass to the surviving owner automatically. TOD and POD designations transfer bank and brokerage accounts without probate. None of these go through your will.

For most families, these non-probate transfers control the majority of their wealth. A typical household with a 401(k), an IRA, a joint checking account, and a life insurance policy may have 80% or more of its assets pass outside the will entirely.

That is not a problem if your designations are current. It becomes a problem when they are not. The most common version of this: someone updates their will after a divorce but forgets to change the beneficiary on their 401(k). The ex-spouse inherits the 401(k). The will cannot override it.

A revocable trust avoids probate for any asset transferred into it during your lifetime. That is its primary function. It does not protect assets from creditors or Medicaid. It does not reduce taxes. It avoids the 6-to-18-month probate process and keeps your estate out of public record.

TOD deeds are available in over 30 states and let you transfer real estate to a named person at death without probate. They are one of the simplest estate planning tools available, and most people have never heard of them.

The key takeaway: your estate plan is not just your will. It is your will plus every beneficiary designation, every account title, every TOD form, and every deed. All of those need to say the same thing.
