Hobby Loss vs. Business Loss: What’s the Difference on Taxes?

Ever wondered why the IRS cares if your side hustle is a hobby or a business? It all comes down to how you report your losses.

Hobby Loss: If you’re doing something for fun (and not to make a profit), any income you earn is taxable, but the expenses? Not deductible.

So, no, you can’t write off the cost of those gourmet cupcakes you baked “just for fun.”

Business Loss: Run your activity like a real business with a clear goal to make money? Then those expenses can be deducted, even if you didn’t turn a profit. That means your losses could offset other income, saving you on taxes.

The key? Profit motive. If you’re not trying to make money, the IRS isn’t giving you a break. But if you’re serious about running a business, keep good records, act professionally, and show them you mean business

Keep your hobbies joyful, and your businesses profitable!

The official start date for tax e-filing is January 27, 2025.

Most of our clients will not qualify for free filing due to their complex income situations. Even if some clients call to ask, "But my income is under $73,000," many have income sources beyond just a W-2, and some work in multiple states. Free e-filing is only available for basic tax filings.

If your taxes are straightforward and basic, there’s no need to hire a CPA. You can do it yourself! For those eligible for free e-filing, we do not provide this service. Other organizations are available to assist with free filing.

Please read the details below:

Restrictions for Free Online Tax Filing (e-File):
The IRS provides free online tax filing options for qualified taxpayers through the IRS Free File program, subject to the following conditions:

Income Limits for Free Federal Tax Filing:

If your Adjusted Gross Income (AGI) is $73,000 or less (for the 2024 tax year), you are eligible to use IRS Free File software.
If your income exceeds this limit, you must use other options, such as hiring a tax professional or filing taxes yourself.
State Tax Filing:

Some programs under Free File include free state tax filing, while others may charge additional fees. Please verify with each software provider to confirm.
Age Restrictions:

Certain Free File providers may have age restrictions, such as being under 50 or over 65 years old. Be sure to check the specific requirements of each provider.
Unsupported Filings:

Free File services typically do not support complex tax filings, such as:
Form 1120 (for corporations)
Form 1065 (for partnerships)
Tax filings for estates or trusts
Certain credits or deductions may also not be supported.
Supported Forms:

Most Free File providers support:
Basic filings (Form 1040)
Common deductions and credits, such as:
Earned Income Tax Credit (EITC)
Child Tax Credit (CTC)
Education credits (e.g., American Opportunity Credit)
How to Access IRS Free File:
Visit the IRS Free File website and use the "Lookup Tool" to find providers that meet your income, age, and state-specific needs.

Oh, so you must be a great cook!”

That’s the reaction I’ve been getting since I graduated with an accounting degree from Johnson & Wales. Yes, Johnson & Wales, the culinary powerhouse!

I thought the “chef” assumptions would fade after my first year out of school, but here I am, still explaining that my skills are better suited for Excel sheets than pie crusts.

Here’s the truth: During my time at JWU, I did spend a LOT of time in restaurants—but not as a chef.
• I was in the lobby crunching numbers.
• In the kitchen (but only to observe).
• In the storage room analyzing inventory (not prepping ingredients).

My Capstone project was even with The Capital Grille in Providence.

During these time I worked alongside owners and managers, not stirring pots or baking bread.

So, while I can’t whip up a soufflé, I can help you manage your restaurant’s finances, streamline payroll, and set up systems to help your business thrive. Leave the cooking to the professionals, and let me handle the spreadsheets!

If you’re in the restaurant business and need help making your numbers look as good as your dishes, let’s talk!

Providence

Do not forget the BOI report!

🚨 Attention Business Owners! BOI Reporting Starts January 1, 2024 – Deadline: January 1, 2025! 🚨

Starting in 2024, businesses need to comply with Beneficial Ownership Information (BOI) reporting under the Corporate Transparency Act.

Key Deadlines and Penalties to Remember: 📅 Deadline for Existing Businesses: January 1, 2025

⚠️ Late Filing Penalty: Up to $500 per day for missed deadlines

💰 False Information Penalty: Fines up to $10,000 and up to 2 years of imprisonment for knowingly providing inaccurate information

Why is This Important?

Under the Corporate Transparency Act, any entity formed as an LLC or corporation is considered a separate legal entity.

This means that if you’ve registered your business as an LLC—even if it’s just you baking cookies or selling handmade crafts—you’ll need to file a BOI report starting January 1, 2024, to comply with this new regulation.
For existing entities, the filing deadline is January 1, 2025.

Many small business owners don’t realize they’re impacted by this new BOI reporting requirement.

Often, they assume that because they’re just one person business , a small operation or they don’t have an accountant to remind them, compliance isn’t something they need to worry about.

If you’re reading this, consider yourself fortunate—you still have 45 days to get everything in order!

Take this time to review your business status and ensure you’re on the right track to meet the deadline.

Take this example:

A college student who loves baking and decides to start selling cookies from home.

To protect herself legally, she sets up an LLC for her small business, not realizing that the LLC classification comes with additional requirements.

Now, under the BOI reporting rule, she’s required to file beneficial ownership information.

This means disclosing her name, address, birth date, and a form of government-issued ID.

Why? Because her LLC is a separate legal entity, distinct from her personal identity—so even though she’s the sole owner, compliance with BOI is still required.

Who Needs to File a BOI Report?

Corporations, LLCs, and similar entities created by registering with a state.

Single-member LLCs and single-shareholder corporations that legally separate personal and business identity.

Who’s Exempt? You don’t need to file if you operate as a sole proprietorship without forming an LLC or corporation, as you are not legally distinct from your business.

Other exempted entities include public companies, regulated banks, certain nonprofits, and large operating companies meeting specific employee and revenue thresholds.

🌴 When Digital Nomads Meet Tax Forms 🌴

Got an email from two of my clients who are truly living the dream—working remotely from Ecuador and the Dominican Republic (and, yes, I’m a little jealous). 😎✨ They’re U.S. citizens, business owners, and they’ve fully embraced the digital nomad lifestyle.

As year-end rolls around, they’re in full “tax-prep mode” and hit me with, “Time to send out our 1099-NECs, right?” 💸 It’s their go-to for everyone… contractors, freelancers, probably even the neighbor’s cat if it could do remote work. 🐱

But here’s the kicker:

👉 If you’re paying non-U.S. contractors doing work outside the U.S., they don’t need a 1099-NEC! What they actually need is Form W-8BEN. Yep, less paperwork, more hammock time. 🏖️

So, here’s your quick tax tip:
If you’re a U.S. business owner enjoying life abroad, don’t send a 1099-NEC to every contractor on the planet. Just grab a W-8BEN from your foreign contractors and call it a day.

📬 Ready to simplify your tax season and get back to the beach? Let’s talk!
