In light of a recent federal court order, reporting companies are not currently required to file beneficial ownership information with FinCEN and are not subject to liability if they fail to do so while the order remains in force. However, reporting companies may continue to voluntarily submit beneficial ownership information reports.

The Corporate Transparency Act (CTA) plays a vital role in protecting the U.S. and international financial systems, as well as people across the country, from illicit finance threats like terrorist financing, drug trafficking, and money laundering. The CTA levels the playing field for tens of millions of law-abiding small businesses across the United States and makes it harder for bad actors to exploit loopholes in order to gain an unfair advantage.

On Tuesday, December 3, 2024, in the case of Texas Top Cop Shop, Inc., et al. v. Garland, et al., No. 4:24-cv-00478 (E.D. Tex.), a federal district court in the Eastern District of Texas, Sherman Division, issued an order granting a nationwide preliminary injunction that: (1) enjoins the CTA, including enforcement of that statute and regulations implementing its beneficial ownership information reporting requirements, and, specifically, (2) stays all deadlines to comply with the CTA’s reporting requirements. The Department of Justice, on behalf of the Department of the Treasury, filed a Notice of Appeal on December 5, 2024.

Texas Top Cop Shop is only one of several cases in which plaintiffs have challenged the CTA that are pending before courts around the country. Several district courts have denied requests to enjoin the CTA, ruling in favor of the Department of the Treasury. The government continues to believe—consistent with the conclusions of the U.S. District Courts for the Eastern District of Virginia and the District of Oregon—that the CTA is constitutional.

While this litigation is ongoing, FinCEN will comply with the order issued by the U.S. District Court for the Eastern District of Texas for as long as it remains in effect. Therefore, reporting companies are not currently required to file their beneficial ownership information with FinCEN and will not be subject to liability if they fail to do so while the preliminary injunction remains in effect. Nevertheless, reporting companies may continue to voluntarily submit beneficial ownership information reports.

I highlighted the bottom of their solicitation that you can file directly with the state at no charge. Just go to the Ms Secretary of State website and do it yourself. Don’t pay these frauds $125.00.

Just wanted to get on here and remind everyone that March is here and April 15th is rapidly approaches. I have had several people ask if I am still preparing taxes. I most definitely am. Someone is in my office from 3pm to 6pm during the week and from 10am to 3pm on Saturday so you can drop off or pick up your tax returns. I also have a locked drop box on my office porch. Before calling the IRS, take a deep breath with me.

Please remember that there are some wonderful people working at the IRS. They have families and souls, just like the rest of us. They pay taxes and have to follow the same laws that we do.

With that being said, here are the steps you need to take to reach a real person on the phone at the IRS.

When to call
The IRS is available from 7 a.m. – 7 p.m. Monday thru Friday. The best time to call is early in the morning.

Make sure you’re prepared
Before you call, make sure you have all of the information that you need.

Social Security cards and birth dates for those who were on the return you are calling about.
An Individual Taxpayer Identification Number (ITIN) letter if you don’t have a Social Security number (SSN)
Filing status – Single, Head of Household, Married Filing Joint or Married Filing Separate
Your prior-year tax return. We may need to verify your identity before answering certain questions
A copy of the tax return you’re calling about
Any letters or notices the IRS sent you
How do you speak to a live person at the IRS?
The IRS telephone number is 1-800-829-1040.
The first question the automated system will ask you is to choose your language.
Once you’ve set your language, do NOT choose Option 1 (regarding refund info). Choose option 2 for “Personal Income Tax” instead.
Next, press 1 for “form, tax history, or payment”.
Next, press 3 “for all other questions.”
Next, press 2 “for all other questions.”
When the system asks you to enter your SSN or EIN to access your account information, do NOT enter anything.
After it asks twice, you will be prompted with another menu.
Press 2 for personal or individual tax questions.
Finally, press 3 for all other inquiries. The system should then transfer you to an agent.

It has come to my attention that some of my clients are trying to get ahold of me through my old cell number. My cell number for my business is now 662-356-4400. You can text me or call me at this number. Last fall Att turned off the old line when I requested to have my hotspot line cut off. They got the numbers mixed up and then Proceeded to tell me they couldn’t give me my old number back.
It has worked out since I was able to turn my remote call forwarding number into my cell number. I’m sorry about the confusion and I hope I never have to change numbers again.

Because of several factors, I am increasing my prices this year. There will be a pricing sheet on my door and my reception desk. I have been putting this off for several years but I am working myself to death for a lot less than I should be making. If this decision makes you leave me to go somewhere else, I am sad to see you go but keep in mind I have 30 years of experience plus I am an enrolled agent and do have a college degree so I should charge more. I feel blessed every year for all of my returning clients and my new ones.

I will function like I did last year. There is a drop box on my porch for drop-offs and I am in the process of hiring someone to work from 2pm to 6pm every week day and 10 to 3 on Saturday to be in the office by Jan 15th to receive drop offs and to let my clients come in and sign and pick-up their copies. I can also receive you tax info by mail or email. If you absolutely need to meet with me, you can call my office number or you can tell whoever is in my office and they can set up an appointment.

I am doing drop offs and pickups unless you feel necessary to see me. I have a drop box on the porch with some envelopes above it for your convenience. When I start preparing the return, I will get in touch with you by either text or phone. When ready, my daughter is in the office from 2 to 6 from Monday to Friday and 10 to 2 on Saturday, so you can sign, pick up your copies and pay me. You can also drop off with her if your are not comfortable using the drop box. I accept cash, credit or debit card and check. I work a full time job in Columbus and this seems to work the best for me. Thank you.

Tax season is here again. Monday January 24th is the first day to efile your tax return. I have decided to not take appointments this year. You can drop off your return information in my drop box on the porch or you can come by the office from 2 to 6 during week and 10 to 2 on Saturday to drop and pick up any completed returns. I will contact you by calling or texting so please make sure I have your phone number on the info you drop off. If you feel like you need to meet me, you can call me at (662) 356-4400, text me at (662) 549-4840 or message me here on facebook. I will return all messages after I get home from work at 6pm.

Don't forget to bring me the letter the IRS is sending out about the advance child tax credit you received. I'll also need to know how much you received back in March. It should have been $1,400 for each qualifying person.
