Open Enrollment begins November 1-understand how the Premium Tax Credit is reconciled before choosing a Marketplace plan.
GBC Building Blocks: If you receive advance premium tax credit (APTC), it can lower your monthly premiums. At tax time, Form 1095-A provides your Marketplace coverage details, and Form 8962 reconciles the advance payments with the credit you qualify for.
What do Treasury/IRS proposed regulations REG-101576-26, issued October 14, propose?
• For tax years beginning after December 31, 2025, remove the cap on repaying excess APTC, generally requiring repayment of the full excess, regardless of income.
• Limit eligibility to U.S. citizens, nationals, and certain lawfully present noncitizens.
• Starting in 2028, have Exchanges verify citizenship or lawful presence, income, and family size before and during coverage.
These rules are proposed, not final, and may change. Comments are due November 30, 2026; a hearing is scheduled for December 8. Keep your Form 1095-A, update income and family-size estimates with the Marketplace during the year, and expect a reconciliation on your return.
