What you need to know about Sales Tax & SAAS in California
If you operate a SAAS (Software as a Service) business in California, understanding what's taxable and when to file sales tax is essential to staying compliant.
1. When to File Sales Tax in CA:
Monthly: If you collect over $1,200 in sales tax per month.
Quarterly: If you collect between $100–$1,200 per month.
Annually: If you collect less than $100/month.
Your due date is the last day of the month following the close of your filing period (e.g., Q1 ends March 31, so you file by April 30).
2. Do SAAS Companies Owe Sales Tax?
In California:
True SAAS (access to software via the cloud) is not taxable, since you're not transferring a physical product or downloaded software.
However, if your product includes downloadable software, customized development, or bundled taxable services, parts may be subject to tax.
If you sell hardware, physical media, or licenses along with your SAAS, those are taxable.
Pro tip: Even if your SAAS product is non-taxable, you still may need to register and file zero returns if you have nexus in California.
