NEVER LET YOUR PARENTS DEED THEIR HOME DIRECTLY TO YOU.

"I'm retiring, so I'm putting the house in your name."
"Dad, stop right there. Don't put that deed in my name."
"What? You don't want the house?"
"Of course I do. But you've owned it for decades and it has gone way up in value. If you transfer it to me today, I'm the one stuck paying capital gains tax when I sell."
"It can't be that much."
"That gap is the whole problem. Hand it over now and I'd owe a huge bill on all that appreciation."
"So what should I do instead?"
"Put the property into a living trust and name me as the beneficiary. Then when you pass, I inherit it with a stepped-up cost basis and skip that tax entirely."

How to do it:
Pull a copy of the current deed. Prepare a new deed (a quitclaim or grant deed) with you as grantor and the living trust as grantee. Sign and date it before a notary. File it at your local land records office.

Once filed, the home sits inside the trust.
