Congress has updated the tax code in a way that benefits businesses investing in U.S. research and development.
Under the One Big Beautiful Bill Act, companies can once again immediately deduct U.S.-based R&D expenses. In many cases, businesses may also amend prior tax returns to claim deductions that were previously required to be amortized.
Small businesses (under $31M in average annual revenue):
• Retroactively deduct R&D costs from 2022–2024
• Amend open returns under standard IRS rules
• Filing deadlines may apply in 2026
• Immediate expensing resumes in 2025
Larger businesses:
• Accelerate remaining R&D deductions from 2022–2024
• Deduct in 2025 or split between 2025–2026
• Use Form 3115 to make the change
