What every PA CPA and small business owner should know about House Bill 1697 👇

The proposed PA False Claims Act would:
✔ Duplicate a federal system PA already uses
✔ Expand enforcement into state and local tax matters
✔ Let private parties — not just state agencies — file tax-related lawsuits
✔ Create financial incentives to sue, with some recovered funds going to private parties instead of the Commonwealth

The result? More lawsuits over routine tax decisions, higher costs, and greater risk for CPAs and small businesses — even when returns are prepared in good faith.

PICPA supports strong fraud enforcement, but good-faith professional judgment shouldn't be treated as fraud. HB 1697 should align with federal law and exclude tax matters.

A False Claims Act allows private individuals to sue on behalf of the government if they believe someone improperly received government funds. These cases are often brought by whistleblowers, who may receive a share of recovered funds. The law also allows for significant financial penalties.

The IRS’s sending of about 1.4 million CP53E notices sparked concerns about errors and fraud. A release from the Taxpayer Advocate Service urged taxpayers to verify their accounts directly on IRS.gov.
