I wanted to share with you some recent developments with the CTA that I heard about from Matt Risenmay with CTA Integrity.

There has been some confusion spread online, and I want to clarify some details.

Here’s the bullet points:
• In 2022, a lawsuit was filed from a small business lobbyist group (NBSA) against the federal government about the legality of the CTA.
• Last Friday (3/1/24), a district judge in Alabama ruled in favor of the plaintiffs (NBSA and its members) and deemed the CTA to be unconstitutional.
• The ruling only applies to the NBSA and its members.
• The federal government is most likely going to appeal the ruling. They also will request a pause on the ruling until the appeal process plays out.
• This exemption only applies to about 40,000 businesses of the 32M that are required to file a BOI report.
• FinCEN has said that they will not enforce CTA penalties against the plaintiffs (NBSA and its members as of March 1, 2024), until the legal process plays out. Businesses outside of this lawsuit are still required to follow the compliance requirements as part of the CTA.
