Married Taxpayers: Choosing the Correct Filing Status
If you’re legally married, your filing options are limited—choosing the wrong status (especially Head of Household) can trigger IRS issues.
YOUR VALID OPTIONS:
1. Married Filing Jointly (MFJ)
* options may apply: "Innocent Spouse" or "Injured Spouse"
2. Married Filing Separately (MFS)
* Each spouse files their own return
* Often used for liability separation or specific tax situations
WHAT ABOUT HEAD OF HOUSEHOLD (HOH)?
* WRONG CHOICE. You may only qualify if you are considered “unmarried” under IRS rules and meet strict requirements (such as living apart from your spouse for the last 6 months of the year and supporting a qualifying dependent).
* Filing Single is not allowed unless you are LEGALLY divorced or separated under a final decree.
Incorrectly claiming HOH can lead to audits, penalties, and additional tax. AND it's considered a FRAUDULENT claim

KWONG RELIEF:
The reason many tax professionals are recommending a protective claim by July 10, 2026 for potential Kwong relief is to preserve a taxpayer's right to a refund before the statute of limitations expires.
Under the interpretation of the court's decision in the historical event Kwong v. Commissioner, certain filing and payment deadlines may have been postponed from January 20, 2020, through July 10, 2023. If that interpretation applies, some taxpayers may be entitled to refunds of:
Failure-to-file penalties
Failure-to-pay penalties
Interest associated with those penalties
Certain estimated tax penalties
The concern is the refund statute under IRC §6511. Generally, a claim for refund must be filed within:
3 years from the date the return was filed, or
2 years from the date the tax was paid,
whichever is later.
Many payments, offsets, and penalty assessments connected to the postponed period could become barred after July 10, 2026, depending on how the postponement period is ultimately applied. Filing a protective claim before that date establishes the taxpayer's claim while the legal and administrative issues continue to develop

IMPORTANT INFORMATION TO READ:
You may qualify for a possible refund or reduction of IRS penalties and interest related to COVID tax relief changes.
During COVID, the IRS extended many tax filing and payment deadlines. A recent court case, Kwong v. Commissioner, found that some deadlines should have been extended even longer, which may allow certain taxpayers to receive relief from penalties and interest.
This may affect taxpayers who:
• Filed 2019, 2020, 2021, or 2022 tax returns
• Owed taxes with the return
• Paid late or were unable to pay by the IRS deadline
• Were charged IRS penalties or interest during the COVID period
Even if you still owe the IRS today, you may still qualify for a reduction or refund of penalties and interest charged during that time.
Important: Claims must be filed by July 10, 2026, to protect your right to request a refund or reduction.
The IRS has appealed the court decision, so approval is not guaranteed. However, taxpayers who do not file a claim may lose the opportunity for relief if the court decision is upheld.
