El propósito de este comunicado es aclarar el funcionamiento de la reciente legislación sobre las horas extra (overtime) y cómo afecta sus impuestos. Existe una confusión común sobre si esto significa “más dinero en el reembolso” o una “reducción de impuestos”.
1. ¿Qué es realmente el beneficio por Overtime?

Check if you're eligible for these benefits as an ITIN applicant and how to claim them:

Spouse Filing a Joint Return

If you're a resident or nonresident alien who's not eligible for an SSN, you can file a joint tax return with a spouse who’s a U.S. citizen or resident alien.

Head Of Household

To claim head of household status:

1. Dependent ITIN applicants must be your qualifying children or qualifying relatives who are related to you. A qualifying relative must either:

Have lived with you for more than half the year (including temporary absences)
Be your parent
Find details in Dependents, Standard Deduction and Filing Information, Publication 501.

2. Your tax return in your ITIN application package must:

Have the Head of Household checked in the filing status box
List the dependent ITIN applicants

Qualifying Surviving Spouse

To claim a qualifying surviving spouse filing status:

1. Dependent ITIN applicants must:

Be your child or stepchild (not a foster child)
Have lived with you the entire year (including temporary absences)
2. Your tax return in your ITIN application package must:

Have the Qualifying Surviving Spouse checked in the filing status box
List the dependent ITIN applicants
Find details in Dependents, Standard Deduction and Filing Information, Publication 501.

America Oportunity Tax credit

This credit lets you claim up to $2,500 for adjusted qualified education expenses paid for each qualifying student. Find details in Tax Benefits for Education, Publication 970.

To claim this credit when you apply for an ITIN:

1. Dependent ITIN applicants must be dependents of the taxpayer who claims this credit.

2. Your tax return in your ITIN application package must include Form 8863 Education Credits (American Opportunity and Lifetime Learning Credits).

Child and Dependent Credits

If you paid someone to care for your child or other qualifying person so you (or your spouse if filing jointly) could work or look for work, you may be able to take the credit for child and dependent care expenses. Find details in Publication 503, Child and Dependent Care Expenses.

To claim this credit when you apply for an ITIN:

Your tax return in your ITIN application package must:

List the dependent ITIN applicant
Include a completed Form 2441, Child and Dependent Care Expenses, that lists the dependent ITIN applicant as a qualifying person
You can submit an ITIN application for a dependent claimed for this credit even if the tax return has no tax to be reduced by the credit.

Credits for Other Dependents ( ODC)

This $500 non-refundable credit is available to taxpayers with dependents who aren’t eligible for the child tax credit. Find details in Schedule 8812 (Form 1040), Credits for Qualifying Children and Other Dependents.

To claim this credit with an ITIN application:

1. Dependent ITIN applicants must be a resident alien or a U.S. national.

2. Your tax return in your ITIN application package must:

List the eligible dependent ITIN applicant
Have the "Credit for other dependents" box checked next to the dependent's name*
Include a completed Schedule 8812 (Form 1040), Credits for Qualifying Children and Other Dependents
*If you prepare your tax return with software, make sure the “Credit for other dependents” box is checked. The software may not automatically check it when no taxpayer identification number is listed on the return. We’ll enter the ITIN on your return when we issue the ITIN.

You can submit an ITIN application for a dependent claimed for this credit even if the tax return has no tax to be reduced by it.

An ITIN is issued by the IRS for federal tax purposes only.

An ITIN doesn't:

Qualify you for Social Security benefits or the Earned Income Tax Credit
Provide or change immigration status
Authorize you to work legally in the U.S.
Serve as identification outside the federal tax system
Who needs an ITIN
You need an ITIN if you have a federal tax purpose and you’re not eligible for an SSN.

What is the Tax Purpose?

You have a federal tax purpose when you:

Are legally required to file a U.S. federal income tax return
Want to claim a refund or allowable tax benefit or report income by filing a tax return*
Can be claimed as a spouse or dependent for an allowable tax benefit
Must provide a tax identification number for another federal tax purpose
Generally, a tax return that contains all zero entries will not show a federal tax purpose. In this case, you don’t need to file a tax return or apply for an ITIN.

*If you earned income but don’t owe tax or aren’t required to file, you may want to file a tax return to get money back. You could be eligible for a refund or a refundable tax credit

Who is eligible for the ITIN?
If you're a resident alien, nonresident alien, or their spouse or dependent, you can apply for an ITIN regardless of immigration status.

Resident alien or nonresident alien

If you're not a U.S. citizen, your tax status can be either:

Resident alien – If you were present in the U.S. for more than 183 days* (substantial presence test) or you’re a lawful permanent resident of the U.S. (green card test)
Nonresident alien – If you don’t meet either the green card or substantial presence test for resident alien status.
*Special day-counting rules apply to certain foreign government-related individuals, teachers, trainees, and students who are temporarily present in the U.S. under certain U.S. visas.

The Child Tax Credit helps families with qualifying children get a tax break. You may be able to claim the credit even if you don't normally file a tax return.

The Child Tax Credit (CTC) is a non-refundable credit that allows people with a qualifying child to reduce their tax liability.
The Additional Child Tax Credit (ACTC) is a refundable part of the CTC. ACTC allows certain taxpayers who are eligible for the CTC to receive a refund if the CTC exceeds their tax liability.
Credit for Other Dependents (ODC) is a non-refundable credit for taxpayers with dependents who are not eligible for the CTC/ACTC.
Who qualifies for the Child Tax Credit/Additional Child Tax Credit?
To qualify for the Child Tax Credit, you (or your spouse, if married filing jointly) and each qualifying child must have a Social Security number that is valid for employment in the United States and issued before the due date of the tax return (including extensions).

Additionally, to be a qualifying child for the 2025 tax year, your child generally must:

Be under 17 at the end of the tax year.
Be your son, daughter, stepchild, eligible foster child, brother, sister, stepbrother, stepsister, half-brother, half-sister, or a descendant of one of these (for example, a grandchild, niece, or nephew).
Not provide more than half of his or her own support for the tax year.
Have lived with you for more than half the tax year.
Be claimed as a dependent on your return.
Not file a joint return for the year (or filed the joint return only to claim a refund of taxes withheld or estimated taxes).
Be a U.S. citizen, U.S. National or a U.S. resident alien.
The Child Tax Credit is worth up to $2,200 per qualifying child. If you have little or no federal income tax liability, you may qualify for the Additional Child Tax Credit, up to $1,700 per qualifying child, depending on your income. You must have earned income of at least $2,500 to be eligible for the ACTC.

You qualify for the full amount of the Child Tax Credit for each qualifying child if you meet all eligibility factors and your annual income is not more than $200,000 ($400,000 if filing a joint return). Parents and guardians with higher incomes may be eligible for partial credit.

If you claimed the Earned Income Tax Credit (EITC) or the Additional Child Tax Credit (ACTC), the IRS cannot issue these refunds before mid-February. This applies to the entire refund, even the portion not associated with these credits. Check Where’s My Refund in mid-to late February for your personalized refund date. Who qualifies for the Credit for Other Dependents?
If you do not meet the criteria to claim the Child Tax Credit or Additional Child Tax Credit, you may qualify for the Credit for Other Dependents (ODC) for your child or dependent. They must:

Be claimed as a dependent on your tax return.
Be a U.S. citizen, U.S. national, or U.S. resident alien.
Have a Social Security number, Individual Taxpayer Identification Number (ITIN), or Adoption Taxpayer Identification Number (ATIN).
The maximum credit amount is $500 for each dependent and begins to decrease in value if your adjusted gross income exceeds $200,000 ($400,000 for married filing jointly).

How to determine eligibility and claim the credits
Use the Interactive Tax Assistant to see if you’re eligible to claim the CTC, ACTC, or ODC.

If you qualify, claim the CTC/ACTC or ODC by entering your children and other dependents on Form 1040, U.S. Individual Income Tax Return, and attaching a completed Schedule 8812, Credits for Qualifying Children and Other Dependents

As the upcoming tax season approaches, please ensure you have all necessary original documentation ready for submission.

Be advised that there are significant changes to IRS tax laws and new federal implementations this year. If you hold a work authorization, a work authorization extension, a permanent resident card, or are currently applying for citizenship, please notify your tax preparation agent. The IRS may require original documentation for verification during its review.

Furthermore, the state of Maryland has announced a new tax credit for children and the implementation of FMLA deductions beginning in 2027.

Please have your materials organized to facilitate an efficient filing process.
