Under the Affordable Care Act, applicable large employers (ALEs) must offer minimum essential coverage that’s affordable and provides minimum value to full-time employees and their dependents. An ALE may be penalized if it fails the affordability test and at least one full-time employee receives a premium tax credit for buying individual coverage through a Health Insurance Marketplace. The required contribution percentage used to determine affordability has been inflation-adjusted from 9.02% to 9.96% for 2026 plan years. And the “affordability” penalty has been inflation-adjusted from $4,350 to $5,010 per applicable employee for 2026 plan years. Contact us for more information.

Are you an owner-employee of a partnership or limited liability company (LLC)? In general, business income that flows through to you for income tax purposes is subject to self-employment taxes. This is true even if the income isn’t distributed to you. But such income may not be subject to self-employment taxes if you’re a limited partner or an LLC member whose ownership is equivalent to a limited partner’s. The additional 0.9% Medicare tax may also apply if wages and self-employment income exceed $200,000 ($250,000 for married joint filers, $125,000 for separate filers). If you have a flexible spending account (FSA) through your employer to help pay for health or dependent care expenses, now’s a good time to check your balance. FSAs generally require you to use the funds by year end or forfeit them. The 2025 pretax contribution limit to a health care FSA is $3,300. To avoid forfeiting health care FSA funds because of the “use-it-or-lose-it” rule, you must incur eligible medical expenses by the last day of the plan year (Dec. 31 for a calendar year plan), unless the plan allows a grace period or $660 rollover. Dependent care FSAs are also generally subject to a use-it-or-lose-it rule. The pretax 2025 contribution limit is $5,000. Additional rules apply.

During the recent government shutdown, many of the IRS’s core functions, such as tax refund processing, audits and nonautomated collection efforts, were temporarily paused. (Work continued that was necessary to implement One Big Beautiful Bill Act provisions and to prepare for the 2026 tax filing season.) Not surprisingly, IRS workers are now dealing with a backlog of returns processing and correspondence work. Staffing reductions in early 2025 and employees taking time off during the holidays may make catching up challenging. Delays could extend into the 2026 filing season. If you’re self-employed and have realized a net profit for the year, you may be eligible for the self-employed health insurance deduction. This is an adjustment to income, rather than an itemized deduction, for premiums you paid on a health insurance policy covering medical care, including a qualified long-term care insurance policy for yourself, your spouse and dependents. The policy can also cover your child who’s under the age of 27 at the end of 2025, even if the child wasn’t a dependent.
