Haven't filed your taxes in several years?

Stop right there before you panic and try to file everything at once.

Here is something most people do not know. The IRS generally only requires six years of back returns to consider you compliant. Not ten. Not every year you missed. Six.

Filing more than the IRS actually requires can trigger new assessments, new penalties, and new interest calculations that would not have existed if you had stuck to the minimum.

I have watched people walk into a tax mill, get told to file everything, and walk out owing thousands more than they had to.

If you are behind, the order matters. The strategy matters. The sequence matters.

Get the book first. Read it before you file a single thing.

California's Franchise Tax Board has up to 20 years to collect back taxes, double the IRS 10-year limit. Here's how the clock starts, pauses, and can reset on you.
Most people think an old California balance just disappears if they wait long enough. It can. But the FTB's 20-year collection statute under Revenue and Taxation Code 19255 starts when your latest liability becomes "due and payable," not when you filed. And because California counts fees as tax liability, a lien fee or collection fee added years later can restart the countdown from that newer date. Waiting it out is the trap.
Covered in this video:

Why the IRS gets 10 years and California gets 20
When the 20-year clock actually starts

If you have a California balance and you've been waiting for it to expire, stop counting and start checking. The only way to know your real expiration date is to pull the account and read what the FTB has actually done to it.

Call 909-570-1103 or go to CallTaxEA.com and tell me what year you're dealing with. If you're not ready to talk, start at CaliClaw.com and learn how the California clock really works before it costs you another decade.

I'm Carlos Samaniego, EA, NTPI Fellow. The Tax Debt Detective. I sat in that chair for eight years before I got out. Now I read these transcripts for people who thought they were two years out and weren't.

The Collector was supposed to hire 2,220 people to process returns this filing season.

It hired 50. Two percent of what it needed.

So the IRS did the only thing left. They pulled HR staff and IT workers. Issued involuntary reassignment orders. Eight hours of daily Zoom training. One employee told a reporter his team was "about as far removed from tax work as possible."

Here is what I need you to understand.

The Collector does not need to be competent to be dangerous. It needs to be automated.

Penalty calculations run whether or not a trained examiner has ever touched your file. Interest stacks every single month. Somewhere in a queue of two million backlogged returns, your situation is aging.

Waiting for the IRS to get its act together is not a plan.

$22.2 billion in suspected PPP and EIDL fraud just got handed over to Treasury for collection.

562,000 files. Cross-referenced against tax returns. Compared line by line against what people swore under penalty of perjury on their loan applications.

Not everyone who took those loans did something wrong. Most business owners were terrified and moving fast. Some got bad advice. Some did not fully understand the rules.

Intent matters very little to a Treasury collection agent running a match report.

What matters is whether your returns and your loan application tell the same story.

If they do, enjoy your weekend.

If they do not, the time to get ahead of this is before the letter arrives. Not after.

Real estate professionals, your slow year may be the leverage you did not know you had.

Here is the part nobody tells you. The IRS uses a formula called Reasonable Collection Potential to decide what you can afford to pay. The formula is based on your current income and expenses. Not your peak year.

When commissions are down, the formula looks different. A year that feels like the worst year of your career can actually work in your favor with the IRS.

But that window closes the moment the market warms back up.

If you have unfiled returns, missed quarterly estimates, or a balance you have been avoiding since the last hot cycle, the slow market is not your enemy. The delay is.

You keep telling yourself you’ll deal with it when things calm down.

After the busy season.
After the next paycheck.
After you find the paperwork.

Meanwhile, the unopened letters stay right where you left them.

That pattern belongs in THE TAX UNDERWORLD because it’s familiar to so many people I help.

Issue #1, “The Vulture Strikes at Night,” is your introduction to that world.

Read it. And if someone you care about has been carrying a tax problem in silence, send them the link.

NEVER IGNORE TAX LETTERS! Or Your Card WILL Be DECLINED!

A simple oversight snowballed. Ignored tax notices led to a declined credit card and a spiraling financial crisis. Now, she's calling in a tax detective to unravel the mess.

The man who rescued me from the IRS said one sentence I have never forgotten.

I had walked into his office with eight years of unfiled returns, a stack of unopened letters, and a story I had been carrying alone. I expected judgment. I expected a lecture. I expected to feel worse leaving than I did walking in.

He looked at me and said this.

"You are not a criminal. You are a good person who made a bad decision. Now let me carry the worry."

That sentence broke something loose in me. Not the tax problem. The shame around the tax problem.

I got out. I became an Enrolled Agent. I built a practice dedicated to pulling people out of the same hole I crawled out of.

Now I say that same sentence to people every week. Because it is true. And because you cannot fix the tax problem while the shame is still driving the car.

If your chest just got tight reading this, this one is for you.

The hardest words to say across this desk are sometimes the simplest.

“I haven’t filed in years.”

I understand the shame behind those words. I went eight years without filing myself. I know how avoidance becomes a habit, and how hard it is to finally let someone see the mess.

Someone helped me face mine.

That experience is part of why THE TAX UNDERWORLD exists.

If you recognize yourself in these stories, I want you to know you can start by telling the truth about where you are.

You don’t have to have everything figured out before you ask for help.

Nobody talks about the shame.

When you owe the IRS, the hardest part is not the money. It is the weight of carrying it alone.

You do not tell your spouse the full number. You do not tell your business partner why cash is tight. You smile through the dinner conversation about everyone else's refund.

I carried that weight for eight years. Eight years of not filing. Eight years of pretending.

You do not have to keep doing this alone.
