Small business filing requirement ended for good - or was it?

This week, the Treasury Department issued a rule that exempts U.S. based small businesses from the onerous requirements of the Corporate Transparency Act (CTA). This rule stops enforcement, but the CTA has not been repealed.

The National Small Business Association (NSBA) filed a Cert petition with the Supreme Court to force the Treasury to agree (by July 22nd) for the Supreme Court to decide if the CTA was constitutional, once and for all.

While the filing requirements for domestic small businesses have ended for now, the law remains. The Treasury or a new administration could decide to begin enforcement again.

As a trustee of the National Small Business Association, Gary voted to sue the federal government to overturn the CTA. He attended the lawsuit press conference at the National Press Club and participated in meetings with their attorneys.

Making a Difference Together! 🫶

We joined Maliece Whatley, one of our tax season team members and GSU professor, at a volunteer event hosted by Rotary Club of Savannah South. The event took place at PACK, a local volunteer-run organization that assembles and delivers weekend meal bags to kids and provides other essential resources to children in need in the community.

It was a meaningful way to step out of the office and support an organization that’s doing incredible work to fight childhood hunger in our area. 👏

Lawsuit filed against new legislation affecting every small business

As a trustee of the National Small Business Association, Gary was present at the press conference announcing their lawsuit in Washington, D.C. at the National Press Club. This legislation, the Corporate Transparency Act, requires all entities (under 20 employers and & $5 million in annual revenues) to provide details of the owners starting in 2024 to the Financial Crimes Enforcement Network. Failure to comply timely can result monetary penalties and up to two years in prison. The stated purpose of the passed legislation is to combat money laundering.

Unless an injunction is granted by the federal court, we will start to contact our clients mid-2023 to gather the required information to file the reports.
