Potential NL Tax Reform on Capital Gains

We wanted to inform you of ongoing developments regarding potential changes to the Dutch tax system, specifically related to capital gains. Currently, the Dutch government is debating a reform that could significantly impact how capital gains are taxed.
At the center of the debate is whether taxes should be applied only upon the sale of assets (the current system) or if unrealized capital gains—essentially, gains on paper—should also be taxed. One side of the debate is advocating for the continuation of taxing capital gains at the point of sale, while others are pushing for a broader tax structure that would include unrealized gains, citing concerns over potential revenue losses. Currently, an unrealized gain tax looks like it would exclude real estate and startup shares.

The decision is expected to be made soon, with a deadline of March this year for any changes to be implemented by 2028. We will be closely monitoring these developments and will keep you updated on any major changes that could affect your tax situation.
