New IRS Abatement Program is on the Horizon

The IRS is preparing to roll out an automatic penalty relief program that could benefit millions of taxpayers with a strong compliance history. According to National Taxpayer Advocate Erin Collins, the new process will automatically remove certain penalties for eligible taxpayers beginning with penalties assessed for tax year 2025.

Currently, taxpayers must request first-time abatement relief by phone or mail if they have not received penalties or failed to file returns during the previous three years. The relief applies to failure-to-file, failure-to-pay and failure-to-deposit penalties. Collins said the IRS delayed implementation while updating its systems to identify eligible taxpayers and automatically process abatements.

Eligible taxpayers will receive notices explaining that penalties were not assessed due to their clean compliance history and reminding them to remain timely with future filings and payments. Collins previously estimated that 1 to 2 million taxpayers qualified for the relief without realizing the option existed, making the change especially significant for practitioners advising compliant clients.

OKLAHOMA TAX COMMISSION DATA BREECH

The Oklahoma Tax Commission (OTC) has confirmed a significant data security incident involving its online taxpayer portal, the Oklahoma Taxpayer Access Point (OkTAP) system. Many taxpayers have or will be contacted by letter. It is not a hoax.

The hackers gained access to certain W-2 and 1099 files stored in the OkTAP system between July 5, 2024, through December 20, 2025 (some letters reference September 18, 2025 – December 20, 2025).
Names and Social Security Numbers (SSNs) from the affected files were exposed. No additional financial account information was specified in official disclosures.

Official notices dated March 27, 2026, were mailed to impacted individuals. The total number of affected taxpayers has not been publicly disclosed, but notifications have gone to Oklahoma residents and at least some out-of-state individuals.
OTC’s Actions

Affected individuals are being offered 12 months of complimentary single-bureau credit monitoring and fraud assistance through Cyberscout (a TransUnion company).

The South Carolina Department of Revenue (SCDOR) has announced an automatic extension of the filing deadline for 2025 South Carolina Individual Income Tax returns to October 15, 2026.

This extension applies automatically to all South Carolina individual returns, so no action is required by you.

This extension is related to ongoing legislative activity. The South Carolina Legislature is considering House Bill 3368, which would update the state’s conformity with the current Internal Revenue Code, including the One Big Beautiful Bill Act (OBBBA). If the legislation is enacted, the SCDOR will issue additional guidance, including instructions for taxpayers who may have already filed their 2025 returns.

No action is required to take advantage of the extended filing deadline.

IMPORTANT PAYMENT INFORMATION:

This extension applies only to filing, not to payment.

· Taxpayers (your clients) must pay at least 90% of their 2025 South Carolina tax liability by April 15, 2026 to avoid penalties and interest.

· Payments can be made through MyDORWAY, the SCDOR’s online payment system, at dor.sc.gov/pay by selecting Individual Income Tax Payment.

Taxpayers who expect a refund are not required to make a payment and may file their returns at any time before October 15, 2026.

The IRS this morning has announced Monday, January 26, 2026 as the start date for accepting e-files of Individual tax cases. As I tell all my clients you can book me early, the IRS always takes a select few cases for testing the computers. I have seen many clients get their cases accepted and refunds in their hands before tax season starts in the previous years.

If you own a business, tomorrow is the day to take a photo of your odometer and if needed, go get the vehicle serviced for third party verification. Any car or truck used in the business needs proof of odometer readings at beginning & end of the year. This must be done no matter if you claim mileage or actual expenses. The mileage is always required. By the way, it is not the Tax Preparer's responsibility to keep the odometer readings yearly. That is on the taxpayer.

2026 TAX YEAR business/medical mileage reimbursement numbers have been released.
**Remember these are not for the 2025 TAX YEAR taxes that we will be doing in a few weeks.

72.5 cents per mile driven for business use, up 2.5 cents from 2025.
20.5 cents per mile driven for medical purposes, down a half cent from 2025.
20.5 cents per mile driven for moving purposes for certain active-duty members of the Armed Forces (and now certain members of the intelligence community), reduced by a half cent from last year.
14 cents per mile driven in service of charitable organizations, equal to the rate in 2025.

25 days until the start of 1099/W2 season for tax purposes. 1099-NECs must be filed on labor paid to a single individual or business (sole Prop or LLC) that totals $600 or more for the year. Remember 1099NECs & W2s must be processed by end of 1/31. There are penalties for failing to issue these forms accordingly.
