While this is a common misconception, nannies are NOT independent contractors and must be provided a W-2 every year for wage and tax reporting.

Nannies, housekeepers, or home health aides are considered employees under common law. It does NOT matter how many hours they work, whether the position is permanent or temporary, or how much you pay the worker.

I know you may be thinking… but why?

To put it simply, if parents seeking to hire a nanny have the right to control how, when and where their child is cared for (i.e. determine where the work takes place, what hours the work must be completed in, etc), the IRS classifies those parents as employers.
