📢 VIRGINIA BUSINESS OWNERS — IMPORTANT RETIREPATH REQUIREMENT
If you own a business in Virginia and do not currently offer your employees a retirement plan, this is something you need to know!
RetirePath Virginia is a state-facilitated retirement savings program designed to give employees access to retirement savings through payroll deductions.
✅ Who is required to register?
Virginia employers are generally required to register for RetirePath if they:
• Have 5 or more eligible employees
• Have been in business for at least 2 years
• Do not currently offer a qualified retirement plan, such as a 401(k), 403(b), SIMPLE IRA, SEP IRA, or certain other qualifying plans
📅 2026 Registration Deadlines
Employers with 10–24 employees: September 30, 2026
Employers with 5–9 employees or 25+ employees: October 30, 2026
Businesses that were required to register during an earlier phase and have not done so should address the requirement as soon as possible.
💰 Does the employer have to contribute?
No! There is no cost to the employer to participate, and employers do not make contributions or matches. Employee contributions are made through payroll deductions.
Employees are not required to participate and may choose to opt out.
⚠️ Don't ignore a RetirePath notice!
Employers that are required to participate and fail to comply may be subject to an annual penalty of up to $200 per eligible employee.
If your business already offers a qualifying retirement plan, you generally do not have to participate in RetirePath, but you may still need to certify your exemption.
