Major delays in processing by the IRS have been a constant source of questions and frustration for our clients. The National Taxpayer Advocate delivered their Annual Report to Congress and details the extent of the issue.

"...Paper is the IRS’s Kryptonite, and the agency is still buried in it.” As of late December, the IRS had backlogs of 6 million unprocessed original individual returns (Forms 1040), 2.3 million unprocessed amended individual returns (Forms 1040-X), more than 2 million unprocessed employer’s quarterly tax returns (Forms 941 and 941-X), and about 5 million pieces of taxpayer correspondence – with some of these submissions dating back at least to April and many taxpayers still waiting for their refunds nine months later."

"Although e-filed returns fared better than paper returns, the report says millions of e-filed returns were suspended during processing due to discrepancies between amounts claimed on the returns and amounts reflected on IRS records. The most common discrepancy involved Recovery Rebate Credit (RRC) claims by taxpayers who did not receive some or all of their stimulus payments as EIPs the prior year. These returns had to be manually reviewed, and the IRS issued more than 11 million math error notices to taxpayers over RRC discrepancies with IRS records. When a taxpayer disagreed with a math error notice and submitted a response, the taxpayer’s response went into the IRS’s paper processing backlog, further delaying the refund."

IR-2022-11, January 12, 2022 — National Taxpayer Advocate Erin M. Collins today released her 2021 Annual Report to Congress, calling calendar year 2021 “the most challenging year taxpayers and tax professionals have ever experienced.”

There have been a number of new programs implemented by the IRS over the last year. Because of this, the IRS will be sending documents to most of our clients that they have never seen. We want you to be aware that these documents may be coming and for you to know to keep them and provide them to us for your tax preparation. These documents will be integral to preparing your personal income tax return correctly for the 2021 tax year.

• Letter 6419 | Shows the total amount of advance child tax credit payments taxpayers received in 2021.
• Letter 6475 | Shows the total amount of the 3rd Economic Impact Payments and any plus-up payments received.

In addition, many of our clients will have Identity Protection PINs from the IRS for the 2021 tax year.

• Letter CP01A | If you have applied for an Identity Protection PIN (IPPIN) with the IRS, either online or by filing Form 14039 Identity Theft Affidavit with a prior year tax return, you will receive this letter in January with your IPPIN for your 2021 return. We will not be able to e-file your personal income tax return without this IPPIN (if applicable).

If you receive any of these letters from the IRS, please make sure to put them with your other important tax documents to provide to us. We expect the IRS to begin sending these letters in January.

COVID Tax Tip 2021-187, December 16, 2021 — The IRS encourages taxpayers to get informed about topics related to filing their federal tax returns in 2022. These topics include special steps related to charitable contributions, economic impact payments and advance child tax credit payments.

Identity Protection PINs - the IRS now has an opt-in program for IPPINs. Previously, you could only get an IPPIN if you had already experienced ID theft. Now you can choose to proactively register for one to protect your tax identity!

"An Identity Protection PIN prevents someone else from filing a tax return using your Social Security number."

Tax professionals cannot currently obtain IPPINs for our clients. Taxpayers must obtain their own IPPIN.

The IRS has extended tax-filing and tax-payment deadlines for all taxpayers in Texas through June 15th. "The declaration permits the IRS to postpone certain tax-filing and tax-payment deadlines for taxpayers who reside or have a business in the disaster area. For instance, certain deadlines falling on or after February 11, 2021 and before June 15, 2021 are postponed through June 15, 2021. Taxpayers also have until June 15 to make 2020 IRA contributions."

TX-2021-02, February 22, 2021 — Victims of winter storms that began February 11, 2021 now have until June 15, 2021, to file various individual and business tax returns and make tax payments, the IRS announced today.

Bipartisan COVID-19 relief bills provide hope for recipients of PPP funds and for additional COVID-19 relief measures. The 2 bills introduced in the Senate yesterday may be passed before year-end, giving some much needed clarity and relief to strained Americans.

The Bipartisan COVID-19 Emergency Relief Act of 2020 contains the following:

PPP & Small Business Support - provides another $300 million to the SBA for small businesses under 300 employees that sustained a 30% revenue loss in any quarter in 2020.

BUSINESS EXPENSES PAID FOR WITH PROCEEDS OF PPP LOANS ARE SPECIFICALLY TAX DEDUCTIBLE, "consistent with Congressional intent in the CARES Act".

The Act would also extend unemployment support for 16 weeks and expand Federal supplemental unemployment insurance benefits by $300 into April 2021.
