South Africa has introduced an Advance Pricing Agreement (APA) programme, expanding SARS’s ability to monitor and enforce compliance on cross-border transactions.

The Tax Administration Laws Amendment Act, 2023, inserted Part IA into Chapter III of the Income Tax Act, 1962 (the Act), thereby introducing the framework for the APA programme.

As explained by the South African Revenue Service (SARS) and National Treasury, the aim of implementing APAs is to keep up with international trends.

At the same time, it also aims to “provide taxpayers with a greater level of certainty when embarking on large-scale international transactions that have transfer pricing implications.”

Tax experts have warned South African taxpayers to understand their rights when SARS enforces collection action on bank accounts or income, saying some actions may be challenged and, in certain cases, reversed.

The revenue service has legal powers to recover unpaid tax, including taking money directly from bank accounts, ordering employers to deduct from salaries, and using third parties to collect debts from taxpayers who are in arrears.

The gist of it was that South Africans are paying too much tax on fuel, and while less noticeable during the good times of low fuel prices, that fiscal state of affairs leaves us vulnerable to oil price shocks. Of course, this became painfully obvious to all South Africans after that first refuel in April.

Temporary fuel tax relief has eased recent price spikes, but its planned phase-out amid high oil prices raises concerns that government is pursuing a false economy – risking broader economic losses that could far exceed the fuel tax revenue it seeks to protect.
